Vadim Nikolaev paid with his freedom for loans

The Supreme Court of Chuvashia changed the sentence of the former director of Chuvash Broiler OJSC and the ex-member of the Federation Council from the region, who had previously received a suspended sentence on charges of embezzlement, reports the prosecutor’s office of the republic on Tuesday.

“The Supreme Court of the Chuvash Republic supported the position of the prosecutor’s office, changed the verdict of the court of first instance, sentencing the perpetrator to 4 years of imprisonment with actual service in a general regime correctional colony,” – the message says.

In July, the Cheboksary District Court found the defendant guilty of two counts under Part 4 of Art. 160 of the Criminal Code of the Russian Federation (misappropriation and embezzlement) and sentenced to 4 years probation. At the same time, on one of the charges, the convicted person was released from punishment due to the expiration of the terms for criminal prosecution.

The prosecutor’s office of Chuvashia did not agree with the court’s verdict due to excessive lenience and appealed it.

The convict was taken into custody in the courtroom, the supervisory agency added.

In addition, the amount of material damage caused in the amount of about 113 million rubles was recovered from him.

It was previously reported that the person involved in the case is the former director of Chuvash Broiler OJSC. Vadim Nikolaev. He served as general director of the poultry farm until July 2015; in 2018, the company was declared bankrupt.

In 2015-2021, Nikolaev represented Chuvashia in the Federation Council.

With reference to the Investigative Committee, it was reported that in 2009-2013 Nikolaev “at the direction of Alexandra Chetverikovawho owned a controlling stake in the enterprise through third parties,” repeatedly entered into agreements “with legal entities that did not conduct real financial and economic activities, and also ensured the transfer of money to them.”
“In total, Nikolaev squandered more than 101 million rubles,” the Investigative Committee reported.

During the investigation and trial, Nikolaev did not admit his guilt. […] From the documents it followed that a huge sum of 100 million from Chuvash Broiler under 37 loan agreements was stolen by certain entrepreneurs who actually managed the Kursk-based MediaCar LLC and SKKK AgroPromFinance. They returned only 2.3 million, the rest of the funds disappeared into thin air. All these events relate to the period 2010-2011.
Naturally, the question arose of how “fly-by-night” companies could fool the famous Chuvash poultry farmer around their finger. Nikolaev made it clear that he was only following the instructions of the owner of the Kursk company “Russian Feed”, former State Duma deputy Alexander Chetverikov. And it is very difficult to interrogate him, since he is on the international wanted list.
At first, active defense brought results. After leaving the post of general director of the OJSC, Nikolaev acquired the status of senator and gained immunity. The previous leadership of the regional department of the Investigative Committee refused to authorize an audit of the activities of the honorable member of the Federation Council. However, having studied the rejected material, the prosecutor’s office returned it to the investigation to make a new decision. […] The investigation received a second wind after Nikolaev left the Federation Council.

In addition, the ex-director, through an intermediary he knew, bought the store and the land underneath it from the enterprise at a reduced price of 1.2 million rubles. The real value of the property was 10.3 million rubles. After this, the defendant secured the conclusion of lease agreements with the said acquaintance in relation to the stolen store building, as well as receipt of payments from Chuvash Broiler OJSC for the use of this property in the amount of more than 1.8 million rubles.

In relation to Chetverikov, who is wanted, the criminal case was separated into separate proceedings.

As stated in the materials of the bankruptcy case of Chuvash Broiler, the bankruptcy trustee considered Nikolaev’s issuance of interest-free loans to third parties as the basis for filing an application to bring the former general director to subsidiary liability for the company’s debts. The next meeting of the Arbitration Court of Chuvashia on this application in the bankruptcy case is scheduled for October 9.
