Today the court of the city of Norilsk sentenced to 15 years in the colony of the former prosecutor of the city Khavaja-Baudi Gutaeva, finding him guilty of taking two bribes (parts 3 and 6 of article 290 of the Criminal Code of the Russian Federation). It was qualified under part 6 of Art. 290 of the Criminal Code of the Russian Federation “Receiving a bribe by an official by prior agreement on an especially large scale.” Muslim Umarov appeared in the case at that time, who brought the prosecutor a monetary reward for patronage in the service in the amount of 3.1 million rubles. A criminal case was initiated against him under part 5 of article 291 of the Criminal Code of the Russian Federation “Giving a bribe to an official on an especially large scale.”
The Norilsk City Court found the defendants guilty of the crimes committed and sentenced Gutaev to 13 years in prison with a fine of 15.5 million rubles and deprivation of the right to hold positions in the public service in the prosecutor’s office for a period of 6 years, on the basis of two sentences – dated February 18, 2022 and from March 24, 2022 – 15 years in prison to be served in a strict regime colony with a fine of 17 million rubles and deprivation of the right to hold positions in the public service in the prosecutor’s office for a period of 8 years.
The court sentenced Muslim Umarov to imprisonment for 12 years to be served in a strict regime colony with a fine of 15.5 million rubles.
Recall that in February 2022, Khavazh-Baudi Gutaev was convicted by the Norilsk City Court for committing a crime under paragraph “c” of Part 5 of Article 290 of the Criminal Code of the Russian Federation “Receiving a bribe by an official for illegal actions on a large scale.” His brother Dokki Akhmedovich Gutaev was a defendant in the case under paragraph “b” of part 3 of article 291.1 of the Criminal Code of the Russian Federation “Mediation in bribery on a large scale” and was sentenced to imprisonment for a period of 9 years with detention in a general regime colony with a fine of 7, 9 million rubles. Another defendant, Farida Isak-oglu Babaev, was charged under paragraph “b” of part 4 of article 291 of the Criminal Code of the Russian Federation “Giving a bribe on a large scale” and was sentenced to 7 years and 10 months in prison with detention in a strict regime colony with a fine of 13.1 million rubles.
As it turned out, in the period from October 25 to November 7, 2018, acting. Prosecutor Gutaev, through the mediation of his brother, while in Norilsk, received a bribe in the amount of 399 thousand rubles from Babaev. The money was intended for the failure to take measures of the prosecutor’s response in sending a statement of claim to the court for a ban on the operation of the restaurant building owned by Zarya LLC in connection with violations of fire safety rules.
