The Arbitration Court of the Rostov Region has completed the sale of the property of Vladimir Nelyubin, the ex-co-owner of Ecoprombank JSC and a former member of the Legislative Assembly of the Perm Territory. He must pay creditors more than 1.2 billion rubles. But Nelyubin was declared bankrupt in 2016, and it is not clear how he will be able to return the money.
Conspiracy theft
It follows from the judicial act that Vladimir Nelyubin is released from fulfilling the claims of creditors, with the exception of two individuals, two individual entrepreneurs and the Federal Tax Service. The total debt is more than 1.238 billion rubles.
Of these, he owes the tax service 31.758 million rubles, Leonid Denisov 199.755 million rubles, Mikhail Potapov 561.7 million rubles, IP Yuri Oreshkin 340.452 million rubles and IP Roman Kravtsov 105.175 million rubles.
Earlier, Vladimir Nelyubin’s debt to registered creditors exceeded 2.84 billion rubles, including 591 million rubles to Ecoprombank.
Recall that the co-owner of Ecoprombank was convicted in May 2019 by the Leninsky Court of Perm. He was found guilty of embezzling 215 million rubles of bank funds in a group of persons by prior agreement and 7 million rubles from a depositor of a credit institution. The court sentenced him to six years and three months in prison in a penal colony.
Nelyubin did not admit his guilt.
Exit on parole
It is worth noting that as soon as problems began in Ecoprombank, Vladimir Nelyubin declared himself financially insolvent. And the procedure for personal bankruptcy, probably in order to avoid unnecessary publicity, took place not in Perm, but for some reason in Rostov-on-Don.
There, he first served his sentence in a general regime colony, since he was registered in the city at the time of the case. But two years later he was transferred to a colony-settlement on the territory of IK-10 in Rostov.
The Permian media, after the verdict, assumed that Nelyubin would spend an incomplete term in captivity. Indeed, in December 2022, the Zheleznodorozhny District Court of Rostov granted the request for parole of the former co-owner of Ecoprombank.
But the prosecutor did not agree with this decision, who filed an appeal to cancel the court decision. In the appeal submission, the prosecutor stated that he considered the decision of the previous instance to be illegal and unmotivated, since the prisoner admitted his guilt only partially, did not repent of his deed and had an outstanding writ of execution for 200 million rubles. Parole in this situation is contrary to the law in criminal proceedings. And in February of this year, the Rostov court left Vladimir Nelyubin in a colony.
However, the decision of the Rostov Regional Court can be appealed in cassation within six months from the date the court decision enters into force. So things can still change.
Nelyubin’s defense, in turn, declares that he has incentives, takes an active part in the public life of the colony-settlement and takes all possible measures to compensate for the damage. But due to the fact that Nelyubin has no income and other property, it is possible to recover damage from him only from his salary, which, of course, is not great. In other words, there is simply nothing to take from Nelyubin.
Controversial person
All manipulations with the venue of the bankruptcy procedure, the obvious improvement in the maintenance of the convicted Nelyubin and his transfer to a colony-settlement can be explained if we recall some facts of his biography. Let’s start with the positives.
Nelyubin, in his own words, is an athlete “to every cell”, a master of sports in Greco-Roman wrestling, an honored coach of Russia. Candidate of Pedagogical Sciences, dissertation topic: “The content and structure of the competitive activity of highly qualified Greco-Roman wrestlers with changes in the conditions for its implementation.”
In addition, he is an authoritative businessman, president of the Perm city martial arts club “Perm Bears”, one of those who stood at the origins of the creation of the United Russia branch in the Kama region.
A person with connections. For example, Defense Minister Sergei Shoigu and, at that time, State Duma deputy, and now a member of the Federation Council Alexander Karelin, petitioned for Nelyubin before the court.
But there was another truth. As local media reported, in the late 80s, Nelyubin was associated with criminal structures, was engaged in racketeering and was tried for extorting one thousand rubles from a waiter from the Siberia restaurant. For greater persuasiveness and intelligibility of his demands, he hit the victim several times. As a result, Nelyubin was detained by law enforcement officers, he was sentenced to two years of corrective labor with a deduction of 20% of his earnings to the state.
In the early 90s, Vladimir Nelyubin began to actively engage in business. Together with Dmitry Rybolovlev, Oleg Lomakin and other persons, Vladimir Nelyubin participated in the privatization of enterprises. The first in the early 1990s were Knez LLP, Finservice Limited LLP, Eridian, SVS. There is practically no information in open sources about what kind of enterprises they were and what they did.
In 1992, an attempt was made on Vladimir Nelyubin. He received a bullet wound, but survived. The perpetrators of the crime have never been identified.
There is little information about the early period of entrepreneurship of Vladimir Nelyubin in the materials of the criminal case on the contract killing of the head of Neftekhimik JSC Evgeny Panteleymonov. In this case, billionaire Dmitry Rybolovlev spent several months in jail, and then was acquitted.
The media cite excerpts from the materials of the criminal case: “In 1994, during the privatization and corporatization of enterprises in the Perm region, D.E. collusion with Lomakin O.G., Nelyubin V.A., Chernyavsky V.B., Rustamov S.Z., Makarov S.E. for the purpose of acquiring at auctions, investment auctions of shares of enterprises located in the Perm region, mainly chemical and petrochemical complex – JSC “Uralkali”, JSC “Silvinit”, JSC “Azot”, JSC “Neftekhimik”, JSC “Metafrax” and others prices slightly higher than the starting ones, as well as the acquisition of shares on the secondary securities market and the prevention of transactions for the purchase of shares by competitors, using the authority of these persons among members of various criminal groups … “.
Vladimir Nelyubin decided to go into politics, being already a well-known businessman in Perm, becoming one of the organizers of the Perm branch of the Unity party in the region. He was a member of the presidium of the regional branch of United Russia, a deputy of the Legislative Assembly of the Perm Territory (2011-2015).
His mentality, however, has not changed much. In any case, at one of the meetings of the United Russia faction in 2013, Nelyubin extremely rudely told MP Ilya Shulkin: “Shut your mouth!”
After this incident, the Permian media started talking about the dominance of criminals in the authorities, but Nelyubin worked for another two years and voluntarily resigned only in 2015, after the start of the bankruptcy proceedings of JSCB Ecoprombank.
Now the main intrigue remains how, being bankrupt, Vladimir Nelyubin will be able to pay back the money. If he does not do this, it will be difficult for him to be released on parole from the colony-settlement where he is now. However, it may be that the debt will not prevent him from being released earlier, and he will give 1.2 billion rubles little by little, as they say, as far as possible.
