Roman Fomichev bargained with the investigation for 2 years in prison
Kirovsky District Court of Yaroslavl on May 11 recognized the deputy of the regional Duma Roman Fomichevaccused under Part 4 of Art. 291.1 (mediation in bribery on an especially large scale) guilty of a crime. Roman Fomichev was sentenced to two years’ imprisonment in a strict regime colony and ordered to pay a fine of 2.9 million rubles. Another criminal case against a convict on two episodes of crimes under paragraph “b” part 4, part 5 of Art. 291 of the Criminal Code of the Russian Federation (giving a bribe to an official on a large and especially large scale) was terminated due to the active cooperation of Roman Fomichev with the investigation and confession. The deputy was taken into custody in the courtroom.
Roman Fomichev was detained by law enforcement agencies in April 2021. The deputy was charged with mediation in giving a bribe to a former official of the regional government Eduard Grebenshchikov in the period from December 1, 2017 to January 13, 2018, on behalf of the briber, to assist in concluding a state contract for the purchase of 30 apartments in Yaroslavl to provide for orphans. The amount of the bribe amounted to 1.49 million rubles.
The prosecutor’s office requested that Roman Fomichev be sentenced to imprisonment for a term of 3.5 years with a fine of 29.9 million rubles.
Roman Fomichev was also accused of giving bribes to the ex-Deputy Director of the Department of Property and Land Relations of the Yaroslavl Region Mikhail Rysev for assistance in concluding state contracts for the acquisition of apartments for orphans in the ownership of the region in the form of 13.6 million rubles. and four mobile phones with a total cost of 461 thousand rubles. p. “b” part 4, part 5 of Art. 291 of the Criminal Code of the Russian Federation (giving a bribe to an official on a large and especially large scale). The deputy voluntarily informed law enforcement agencies about the commission of two episodes of bribes and contributed to the investigation during investigations crimes, on the basis of which the criminal case was dismissed.
Roman Fomichev made a deal with the investigation and handed over the names of officials who took bribes, counting on a mitigation of punishment. Initially, the deputy was accused of three episodes, two of which are especially serious and involve a sentence of more than 10 years in prison. But the deal worked, and at a meeting on May 1, the state prosecutor from the prosecutor’s office of the Yaroslavl region no longer insisted on harsh punishment, canceling two of the three episodes.

The prosecutor’s office finally insisted on convicting Fomichev on one episode for mediation in bribery on an especially large scale and agreed with the proposal of the defense to stop criminal prosecution, release Fomichev from criminal liability for two episodes of bribes committed by him, in view of the fulfillment of the conditions of the pre-trial agreement, – said the prosecutor Alexander Barabanov.
Prosecutor’s office during the judicial debate requested that Roman Fomichev be sentenced to 3.5 years in prison in a strict regime colony with a fine of 29.9 million rubles. in the framework of a criminal case under Part 4 of Art. 291.1 (mediation in bribery on an especially large scale). During the debate, the defense side asked the court to impose a sentence on Roman Fomichev not related to real deprivation of liberty. According to the decision of the Kirovsky District Court, the time Roman Fomichev was under house arrest from April 4, 2021 to May 10, 2022 will be counted as a term of imprisonment. Two days of being under house arrest will be counted as one day of imprisonment. The terms of the deputy’s detention from April 1 to April 3, 2021 and from May 11, 2022 until the court’s sentence enters into force will be counted towards the term of imprisonment at the rate of “one day of detention for one day of serving a sentence in a strict regime colony.” Also, the deputy was deprived of the right to hold certain positions related to the implementation of the functions of representatives of government and local self-government for two years. The verdict can be appealed to the Yaroslavl Regional Court within 10 days from the date of announcement.
Bribe-taker Mikhail Rysev, who was detained by law enforcement agencies, was extended his detention until July 2, 2022. Former Deputy Chief of Staff of the Yaroslavl Government Eduard Grebenshchikov will be tried for briberywhose dacha was mediated by Roman Fomichev.
