[…] According to Kommersant, the charge of attempting to steal a large amount of money was brought against the former deputy managing director of YaShZ Avia, Kirill Vasiliev and his wife Zhaneta Stumbraite. In 2020, with the help of a fictitious employment contract, he got his wife a job at this enterprise, which is the largest Russian developer and manufacturer of aircraft tires for aircraft and helicopters. The woman was appointed Deputy Managing Director for General Affairs. One of the clauses in the contract was the following condition – in case of dismissal of an employee at the initiative of the employer within 10 years, he is paid vacation pay in the amount of 50 million rubles.
Zhaneta was paid an advance – 50 thousand rubles, and after a while the management of the enterprise changed. Kirill Vasilyev left the company “YaShZ Avia”, and his wife stopped paying salaries. On December 1, 2020, Ms. Stumbraite demanded that the LLC pay off the debt – 300 thousand rubles, as well as interest for delayed wages. Having not received the money, in March 2021, the woman applied to the labor inspectorate and filed a lawsuit with the Troitsky District Court of Moscow. In court, she also presented a contract that said “golden parachute.” And in July 2021, the court refused Zhaneta Stumbraite, indicating in the decision that “the plaintiff did not provide evidence that reliably confirms the existence of an employment relationship between her and YaShZ Avia.”
In the course of the investigation, it turned out that in the work book of Zhaneta Stumbraite there is no record of being hired by YaShZ Avia, she did not apply to the plant with a corresponding statement. According to Kommersant, the investigation concluded that the actions aimed at the theft of 50 million were not completed due to circumstances beyond the control of the accused. We add that the spouses do not admit guilt in attempted theft.
“Kommersant”, 01/30/2023, “Golden Parachute” was not allowed to land”: According to the investigation, at the beginning of 2020, Mr. Vasiliev planned the scam, based on his knowledge of the peculiarities of the enterprise’s document flow and the presence of large sums of money in his accounts. Another important factor was Mr. Vasiliev’s trusting relationship with the then head of the enterprise, Boris Shalagin. He, as follows from the materials of the case, perceived Mr. Vasiliev as a representative of the owner of the plant and, in particular, consulted with him on personnel matters. First, according to the investigation, at the direction of Mr. Vasilyev, a fictitious employment contract was made between YASHZ Avia and Mrs. Stumbraite. According to him, a woman was appointed to the position of Deputy Managing Director for General Affairs. […] At the same time, Zhaneta Stumbraite, who at one time, according to Kommersant, received the specialty of a dressmaker of women’s outerwear, did not have a higher education and since 1998 has not worked anywhere.
Be that as it may, the woman signed the contract, and the spouses, according to the case, “knew for certain” that the official duties set out in the contract would not be performed by her. After that, in order to give the contract “legally significant force”, Mr. Vasilyev brought it to the signature of the managing director Boris Shalagin. And he, “misled” by his subordinates, signed the contract and the order for the appointment of Janeta Stumbright. Meanwhile, the defendants, according to representatives of the injured party, “begin to put pressure on witnesses, demanding that their testimony be changed.” In particular, Boris Shalagin complained about this. According to Kommersant, at the end of last year, Kirill Vasiliev and his wife were charged with attempted fraud committed by a group of people on an especially large scale. Moreover, the former deputy director of YaShZ Avia was charged in absentia. According to investigators, the man fled. He is currently on the wanted list.
It is reported that a second episode may appear in this case. In May 2020, Kirill Vasilyev himself concluded an agreement with a company that is part of the YaShZ Avia group, which also includes a clause on the payment of the “golden parachute”. The amount is the same – 50 million rubles. Vasiliev applied with this agreement to the Zyuzinsky Court of Moscow, but the claim was denied there. The matter is under investigation.
