The qualifying sign “serious consequences” was excluded from the charge, the cost of Seismorazvedka's business reputation was reduced by 333 times, and the defendant, who faced a ten-year sentence, was only fined.

President GSR Vladimir Tolkachev was forced to leave his post last fall, after a large-scale audit organized by the new owner of the company, Bank of non-core assets “Trust”. The conclusions of the inspectors were disappointing for the former management team.

The inspectors decided that under the leadership of Mr. Tolkachev, the once largest exploration company in Russia stopped paying debts on loans and investing in equipment.

This led to the failure of almost all tractors used by the GSR for seismic surveys with mobile vibration units Nomad 65 and Nomad 90 neo on board; of the 42 field parties working for the firm, about 15 remained on its staff, and the share of the GSR in the core services market was halved.

According to the inspectors, the cause of all the problems of the company could be, among other things, the personal financial uncleanliness of the former president of the company. As follows from their application to the economic security service of the FSB, the ex-head of the GSR committed at least two major official abuses. Firstly, he took a loan from the company's funds for 42 million rubles for personal needs, and returned the money, while significantly reducing the accrued interest. According to the applicants, the company suffered direct damage in this way in the amount of 788 thousand rubles. Another financial violation of the former president, the authors of the complaint considered bonuses totaling 3.1 million rubles, which Mr. Tolkachev had previously issued to his subordinates – the Vice President, Head of the Treasury of the GSR and Director of Procurement and Logistics. The complainants believed that the president should have first agreed on the size of the remuneration with the company's board of directors. reason for the unilateral rupture of previously concluded contracts. The reputational damage caused to the company, according to the injured party, amounted to 100 million rubles.

Based on the findings of an internal audit, a criminal case was initiated in the ICR department for the Central Administrative District of Moscow on Mr. Tolkachev's official abuse, and the investigation considered that the actions of the former official had serious consequences for the company he headed (part 2 of article 201 of the Criminal Code of the Russian Federation). The court reduced the reputational damage claimed by representatives of the GSR by 333 times – to 300 thousand rubles, and the direct damage allegedly caused to the company by the defendants by 788 thousand rubles. recommended that they be discussed in another, civil process.

The Khamovnichesky District Court believes that grave consequences from the actions of Vladimir Tolkachev also did not occur, therefore the crime imputed to the defendant was reclassified to part 1 of the same article of the Criminal Code of the Russian Federation, no longer classified as serious. With this in mind, the geologist escaped with a fine of 200 thousand rubles. It is worth noting that the episode with the bonuses issued to the subordinate was not even discussed at the trial – the ICR refused to initiate a criminal case on this fact even at the stage of the pre-investigation check. it was the defense that convinced the court that its client did not inflict any reputational damage on Geoteka Seismic Services, and, consequently, its activities also did not have any serious consequences. “I am glad that it was not in vain, as they say, that I ate my own bread,” the defender noted.
