The former chairman of the board of Roskomsnabbank (the license was revoked in 2019) Flyur Gallyamov, according to the decision of the arbitration court of Bashkiria, must pay 25.6 million rubles. In this amount, the court assessed the amount of losses caused by Mr. Gallyamov to the bank. The Deposit Insurance Agency, which conducts bankruptcy proceedings at the bank and filed a lawsuit, asked to recover 4.5 billion rubles from him and his former subordinates. The reasoning of the court’s decision has not yet been published. The DIA does not recognize the court’s decision and is preparing to file an appeal.
The Arbitration Court of Bashkiria recovered losses in the amount of 25.6 million rubles from the former chairman of the board of Roskomsnabbank, Flyur Gallyamov. Thus, the court partially satisfied the application of the Deposit Insurance Agency, which is conducting bankruptcy proceedings at the bank, sent to the court in November 2021.
The DIA asked to recover 4.5 billion rubles. losses not only from Mr. Gallyamov, but also from his former subordinates and shareholders of the bank. The lawsuit included Deputy Chairman of the Board Rustem Mukhtarov and Irek Takiullin, Financial Director Denis Ognevsky, Head of the Credit Department Ruslan Shaikhutdinov, Deputy Head of the Credit Department Nail Shaimuratov, Head of the Moscow office of the bank Pavel Medvedev, as well as shareholders Ira Latypova and Irik Abdullin.
They were also co-defendants in another DIA suit – on bringing to subsidiary liability for 18.2 billion rubles. The bankruptcy trustee of Roskomsnabbank sent this statement to the court in March of this year. The DIA then substantiated the filing of the claim by the fact that “the bank issued loans to borrowers who were obviously unable to fulfill their obligations to repay the debt.” “Also, the persons controlling the bank carried out actions to terminate agreements that ensure the fulfillment of obligations under loans, withdraw liquid property from the bank, and replace liquid assets with unsecured debt,” the manager noted.
In June, both lawsuits were combined to joint consideration.
Why the court held only Flyura Gallyamov liable and dismissed the rest of the claims was not found out yesterday: the reasoning part of the decision has not yet been published.
Roskomsnabbank was controlled by the family of the Ufa businessman Flyur Gallyamov. In 2019, the Central Bank revoked its license due to repeated violations of the requirements of the law “On countering the legalization (laundering) of proceeds from crime”, unfair actions of the management related to participation in customer transactions, “aimed at attracting funds from the population with unobvious prospects their return under a scheme that has signs of a “financial pyramid”. As Kommersant wrote, the bank attracted deposits from individuals at an increased interest rate in favor of the Golden Reserve crowdfunding platform. The funds were ultimately used to provide loans to a number of companies. At the same time, the repayment of obligations to individuals for such contributions was actually carried out at the expense of newly attracted funds from the population.
After the revocation of the license, the depositors of the “Gold Reserve”, which positioned itself as an online investment platform that attracts loans from the population at 10-16%, sent a statement to the Russian Ministry of Internal Affairs with a demand to investigate the facts of fraud, which, according to them, became victims of more than 4 thousand citizens, lost about 2 billion rubles during the revocation of the license of Roskomsnabbank. In the summer of 2021, the Main Investigation Department of the Ministry of Internal Affairs for Bashkiria opened a criminal case on the fact of fraud. At the same time, Roskomsnabbank was declared bankrupt at the request of the Central Bank. The meeting to consider the report of the bankruptcy trustee is scheduled for January 10, 2023.
At the time of revocation of the license, Roskomsnabbank’s obligations to 3 thousand loans were estimated at 22 billion rubles. According to the DIA, at the beginning of October this year, only 7.5% of the claims were satisfied – for 1.6 billion rubles.
The press service of the DIA yesterday called the court’s decision “illegal and unreasonable.” The agency intends to file an appeal.
