Previously, it belonged to Ritual LLC: the company and the bureau appear in the criminal case of Andrey Prigarov, ex-prosecutor of the Kirovsky district.
At the same time, during the consideration of the issue of the building, the wording changed: we are not talking about the illegality and demolition of the building, only about the change of ownership. “BV” got acquainted with the documents and found out with whose approval the city land passed into private hands.
12 The AAC denied LLC “Ritual” and its founder Oleg Vartanov an appeal against the decision of the first instance. It concerned the recognition of ownership of the building of the Bureau of Funeral Services (1 thousand sq. M.) And the recognition of the invalidity of the contract for the sale of a land plot of 5.1 thousand square meters. m, subsequently divided by three.
Since the type of purpose of the site is for a crematorium, the “Bureau” is actually considered as such, although, according to “BV”, the corresponding equipment is not yet there.
Recall that the administration of Saratov and the prosecutor’s office of the Saratov region, respectively, applied to the court with such requirements. And initially officials were talking about the demolition of the building. Now it turns out that by a court decision, the municipality received a ready-made building for a crematorium – without investing a penny.
From the court documents, you can trace the entire history of the transfer of the site and the issuance of a building permit. It began in 2007 under the head of Oleg Grishchenko, when a contract was signed between the city KUI, whose chairman was then Sergey Velikanov, and MUSPP “Ritual”. As part of it, the IUSSP received eight non-residential facilities for management with a total area of 2.3 thousand square meters. m. Including the workshop building (257.4 sq.m.), put into operation in 1989.
By September 2016, already under Valery Saraev, land plots were formed, including the one on which the specified workshop was located (8.8 thousand sq. M.). The land was also leased to the MUSPP, whose director Mikhail Shulekin managed to become. The reason for this was just the fact that the company owned the workshop building located here.
A month and a half after that, MUSPP “Ritual” sold the workshop building to the newly created LLC “Ritual” at an auction. The sale price is 1.5 million rubles. In December, the MUSPP terminated the land lease agreement, and by April 2017, by a decree of the head of the Saratov administration, another land plot (an area of 5.1 thousand sq.m.) was formed from it.
In July, the mayor’s office leased it to LLC for a period of 49 years. Then the type of its purpose was – for logistics facilities, warehouse complexes, wholesale bases, warehouses, production bases. By this time, the first director of the private “Ritual” Alexander Bulgakov had already managed to become the director of the MKU “Administration of cemeteries”, demonstrating an enviable cycle of directors in nature.
After 20 days, MUSPP “Ritual” began the second part of the Marlezon ballet, renting a land plot from the municipality (3.6 thousand square meters), received after the section of the above-mentioned plot of 5 thousand square meters.
The basis is the same – the enterprise had previously taken possession of the bureau located on it, the funeral service store. At the end of September 2017, the administration issued a town-planning plan for the site to LLC. The duties of the head of the administration were then performed by Sergei Pilipenko.
In July 2018, the new mayor, Mikhail Isaev, signed a permit to deviate from the limiting construction parameters. And in October, the mayor’s office sold the land for the office, received in 2017 on a lease for 49 years. Moreover, in the statement of “Ritual” it was indicated that the purpose of presenting the land plot is a crematorium. The reason for the transaction was the same article of the Land Code of the Russian Federation, which allows claiming land if a building owned by the applicants is located on it. In June 2019, LLC received permission to build a funeral services office.
In December 2019, LLC informed the KUI about the completion of the demolition of the workshop located here.
At the same time, the regional prosecutor’s office found that on a land plot (3.7 thousand square meters), such an object as a workshop sold by MUSPP LLC was demolished. But LLC registered the ownership of the new building.
As a result, the appeal supported the decision of the court of first instance to terminate the contract for the sale of the workshop building, considering that it was sold without a land plot assigned to it, which violated the interests of the municipality. And the arguments of the appellants with reference to the fact that the land plot was leased, as a result of which the court’s conclusion that the rights to real estate are exercised separately from the rights to the land plot are erroneous, are based on a misinterpretation of the norms of the current legislation and are untenable.
The court also took into account the opinion of the first instance that the administration knew about the intention of Ritual LLC to build a crematorium on the site, and not to operate the purchased workshop. Moreover, the land under the object should be provided with the same type of use as the object itself.
Recall that the photo of this bureau-crematorium illustrates the location of the Ritual company, under the brand of which two individual entrepreneurs operate, probably affiliated with the current (Alexandra Umirova) and past (Mikhail Shulekin) management of the MUSPP Ritual.
The very building of the “Bureau” appears in the criminal case against the ex-prosecutor of the Kirovsky district of Saratov, Andrei Prigarov and Oleg Vartanov. Recall that, according to the prosecution, in 2017, having learned about the intention of Ritual LLC to build a crematorium at the Elshansky cemetery, the investigation considers Mikhail Shulekin to be the actual interest in the construction, the law enforcement officer turned to the latter with a proposal to pay him at least 500 thousand rubles a month. At the same time, half of the share in the LLC must be transferred to its trustee Oleg Vartanov. For this, Mr. Prigarov allegedly promised Mikhail Shulekin that he would not take prosecutorial response measures in cases where violations were allowed during the construction of the House of Funeral Services.
Mikhail Shulekin allegedly agreed to the conditions of Mr. Prigarov and transferred 7.7 million rubles to him by the end of 2020, while Mr. Prigarov did not receive any money personally. By agreement between the parties, they entered Ritual LLC, which sent them to the construction of the House of Funeral Services. As a result, according to the prosecution, from 2019 to 2020, the accused received a bribe in installments in the amount of 7.7 million rubles through Oleg Vartanov. and a 50% stake in “Ritual” worth more than 2.5 million rubles, that is, only 10.2 million rubles. mediation in receiving a bribe (part 4 of article 291.1 of the Criminal Code of the Russian Federation). It was assumed that the verdict in this case would be delivered before the end of 2022, but the trial is still ongoing.
