Plan for two billion: how Vladimir Dudochkin encroached on Russian lands

The start of the scandalous story of deforestation in New Moscow for the sake of building a school was given by the head of Troitsk Vladimir Dudochkin, human rights activists say.

The program signed by him back in 2017 launched a mechanism for the development of federal lands, which the municipal official had no right to dispose of. According to activists, Dudochkin hid information about the ownership of the plots, which led not only to mass protests by Troitsk residents, but also to losses for the budget. About how businessmen illegally transferred almost 2 billion rubles from the treasury of Moscow and caused enormous damage to the federal center, as well as about the connivance of law enforcement officers, read in the PASMI material.

On March 23, the situation around deforestation in Novomoskovsk Troitsk became the subject of discussion in the Moscow City Duma, where Oleg Baranov, head of the Main Directorate of the Ministry of Internal Affairs of Moscow, spoke with a report on the work of the metropolitan police. Recall that since the beginning of January, local residents have been trying to resist the plans of the authorities to build a school building for 2100 places and a kindergarten for 300 pupils right in the forest. The townspeople blocked the access roads, despite the mass detentions, however, more than 5 hectares of forest were cut down.

The question of the scandalous construction site at a meeting of the city parliament was asked by the deputy from the Communist Party of the Russian Federation Nikolai Zubrilin to the chief metropolitan policeman. He drew attention to the lack of reaction of law enforcement officers to the facts of attacks on forest defenders by employees of private security companies hired by the developer, and asked a direct question: why does big business actually subordinate state bodies represented by the police to their commercial interests?

In response, Oleg Baranov declared the legality of the construction, explaining that the residents of the TiNAO themselves turned to Mayor Sergei Sobyanin with a request to eliminate the shortage of places in schools and preschool institutions, that the building site was selected with the participation of the public, and there was no talk of causing significant damage to the Troitsky Forest goes – allegedly cut down only a few dozen trees and small shrubs.

As for the protests, according to the head of the central office, they were organized not by locals at all, but by a certain resident of the Odintsovo district. “Probably, he is very worried about every tree, for which, as they say, you can only thank him,” Oleg Baranov noted.

Apparently, he meant the representative of the regional public association “Right? Yes!” Anton Mogilnikov, who really lives in Odintsovo and provides legal assistance to Trojans who disagree with the destruction of the forest.

Earlier in an interview with PASMI activist declared about violations of the law committed by municipal and regional officials in the situation around the Trinity Forest, paying special attention to the fact that the authorities of Troitsk, in principle, could not dispose of the sites on which they are trying to start construction. Anton Mogilnikov explained that these are the lands of the former forest fund, which are federal property and are protected by the legislation of the Russian Federation. At the same time, neither the inclusion of land within the boundaries of the settlement, nor the fact that after the annexation of the territories near Moscow to the capital they were declared the green fund of Moscow, do not stop or redistribute the right of ownership.

Anton Mogilnikov presented his arguments not only to the editors of PASMI – he sent applications to the Moscow prosecutor’s office, the Main Investigative Committee of the ICR and the Main Directorate of the Ministry of Internal Affairs of Moscow, as well as to the Federal Property Management Agency, Rosleskhoz, Rosprirodnadzor and other federal departments. According to the public activist, the actions of a number of officials contain signs of corruption-related crimes that have led to a violation of the property rights of the Russian Federation and the legitimate interests of citizens, provided for by a number of articles of the Criminal Code, including forgery, abuse of power, negligence and ecocide. But law enforcement and supervisory authorities have not yet responded to the message about a possible crime.

Nevertheless, Anton Mogilnikov made another attempt to get through to the Moscow prosecutor’s office, as well as to the regional departments of the Ministry of Internal Affairs and the TFR. Now he is asking to bring directly to justice the head of the city district of Troitsk, Vladimir Dudochkin, whose actions may also contain signs of a crime under a number of articles of the Criminal Code of the Russian Federation.

As the activist explained in an interview with a PASMI journalist, this is primarily about the municipal program “Development of a project for planning the territory and a project for land surveying for the placement of a school for 2100 places with an access road in the V microdistrict of the Troitsk city district in the city of Moscow,” which Dudochkin approved in September 2017.

It was this program that marked the beginning of the illegal development of federal lands, to which the administration of Troitsk had no rights, Anton Mogilnikov is sure, and this development began to be carried out at the expense of the municipal budget – about 9.5 million rubles were allocated for the program by Dudochkin’s decision.

7.5 million of them were spent on the development of a territory planning project and a land surveying project for the above school and an access road to it. Corresponding the contract the administration of Troitsk concluded with the “Institute of the General Plan of Moscow” in December 2017.

As the interlocutor of the editorial office explained, here we are talking not only about the misappropriation of budgetary funds of the municipality, but also about concealing information that this territory is owned by the Russian Federation: the documents for the contract lack not only information about the owner of land plots that fall within the boundaries of the design , but also data that these are forest lands.

Subsequently, on the basis of the land survey project approved by Vladimir Dudochkin, three land plots were put on cadastral registration: two – for a school and a kindergarten, and one more – with the type of permitted use “street and road network”.

At the same time, deliberately false information was entered into the state cadastre about the lack of rights to these land plots, which are formed within the boundaries of forest lands, that is, federal property. According to Anton Mogilnikov, the violation of the law, apparently, was committed precisely at the suggestion of the Troitsk administration, which hid this data from the Department of City Property of Moscow.

The next step was the conclusion of an agreement for the gratuitous use of building plots between the Office for Registration of Property Relations of the above department and Academproekt LLC. At the same time, this company is not a construction contractor, and therefore, there is a violation of the Land Code of the Russian Federation, which can be qualified as abuse of power, Anton Mogilnikov noted. By the way, the head of administration Dudochkin issued a building permit not to the developer, but to the same Academproekt.

Hectares of lawlessness

Thus, according to the activist, as a result of the actions of the head of the city district of Troitsk, about 2 billion rubles were illegally transferred from the municipal and regional budgets. This amount does not include irreparable environmental damage to forest lands, as well as material damage directly inflicted on the Russian Federation in connection with the destruction of more than 5 hectares of ancient forest. It will be possible to evaluate this damage in monetary terms only after the examination.

In his statement to the capital’s law enforcement officers, the human rights activist demands to suspend work on forest plots, withdraw them from illegal use, recultivate and bring to justice the head of Troitsk, Vladimir Dudochkin, and other guilty persons.

In the meantime, as follows from the letter from Mosgosstroynadzor, the capital’s officials have already received notice of the start of construction in the Trinity Forest. Anton Mogilnikov also announced the intensification of work on the federal forest lands – according to him, the construction site is being cleared there, the soil is already being removed.

Continued attempts by citizens to resist violations of the law. Opponents of the construction are on duty at the gate, preventing the removal of the cut down forest. By the way, according to the public figure, this wood, the cost of which can be estimated at 10-15 million rubles, is not accounted for in accordance with the requirements of federal law.
