Moscow Grid Company (MSK) filed a lawsuit against the Bank of Non-core Assets Trust with the Arbitration Court of St. Petersburg and the Leningrad Region to challenge the results of the auction. The Mikhailovsky agro-industrial complex (part of the Cherkizovo Group) and the Russian Auction House (RAD) are also defendants in this case. There are no other details yet, the application itself has not been accepted for production.
On December 21, 2022, Trust sold the large agro-industrial group Healthy Farm to the Mikhailovsky complex at an auction on the RAD site. The lot was supposed to go to her at a starting price of 4.03 billion rubles. According to Kontur.Fokus, 100% of the shares of legal entities belonging to Healthy Farm, including Turbaslinsky Broiler, Healthy Farm Delicacies, Trade House Healthy Farm, Uralbroiler and Ural Meat Company, Since December 27, they have been owned by the Mikhailovsky APK. Cherkizovo did not provide an operational comment. The same was done in the RAD.
The representative of “Trust” clarified that MSK tried to participate in these auctions, but was not admitted to them due to the lack of consent to the acquisition of the asset by the Federal Antimonopoly Service (FAS). The representative of the latter also did not provide a comment.
At the time of the sale, Healthy Farm Group included two poultry farms capable of producing 120,000 tons of poultry meat and 18,000 tons of processed products, as well as feed production. The group, stated in the presentation of the object, occupies 30% of the broiler market in the Chelyabinsk region. Until 2015, Healthy Farm Group was owned by State Duma deputy Oleg Kolesnikov, and then moved to Rusgrain Holding, which is associated with ex-shareholder of Binbank Mikail Shishkhanov.
According to Kontur.Fokus, 50.3% of MSK is owned by ZPIF Quark managed by Baltinvest UK, another 49.7% is owned by co-owner of Adamant holding Vladimir Golubev. Inquiries to Baltinvest UK and Adamant remained unanswered.
Reznichenko Law Offices partner Andrei Reznichenko admits that MSC has a chance to challenge the results of the auction. He draws attention to the fact that only a month was given for filing applications, and it is rather difficult to prepare an application and obtain FAS approval within this period. In this regard, in his opinion, the presentation of such a requirement to a participant in the procedure could lead to a restriction of competition.
Earlier, MSK already became the owner of several assets in the Volga region and the Urals, which, apparently, allowed the company’s owners to assess the prospects for the poultry business in this region, one of the local producers explains the interest of this company in Healthy Farm. According to Fedresurs, on December 3 MSK for 3.3 billion rubles. acquired the Bashkir Poultry Complex named after Gafuri, its capacity is more than 20,000 tons of turkey per year. In addition, the company may be associated with the Nizhnetatyinsky Poultry Farm.
At least, according to the Unified State Register of Legal Entities, 50% of it belongs to Svetlana Bogdanova, director of the MSC. “Healthy Farm”, continues the interlocutor, is an interesting asset, since it already has a strong regional brand, as well as modern production, which will not require additional investments.
