Dmitry Kiva and Sergey Merenkov
The highest court finally recognized Sergei Merenkov as the legal head of the State Enterprise Antonov. On February 18, the Supreme Administrative Court of Ukraine recognized as valid the order of the Ministry of Industrial Policy of July 24, 2014, according to which Sergei Merenkov should act as president and general designer of the Antonov State Enterprise. This was reported by the plant’s lawyer Andrey Gal. This court decision entered into legal force from the moment of proclamation and is not subject to appeal.
Thus, Dmitry Kiva has finally lost his legal grounds to hold the position of president – general designer of the Antonov State Enterprise.
Earlier, on September 4, 2014, the District Administrative Court of Kyiv issued a ruling according to which Dmitry Kiva was reinstated as the head of the Antonov State Enterprise. In November 2014, the Kiev Administrative Court of Appeal rejected the complaint of the Prosecutor General’s Office and the Ministry of Industrial Policy and upheld the decision of the Kyiv District Administrative Court of September 4, 2014.
One interesting fact is that the Ministry of Industrial Policy was reorganized in March 2014 and merged with the Ministry of Economic Development and Trade. Thus, GP Antonov is subordinate to Aivaras Abromavicius and it is unknown whether the decision of the Supreme Administrative Court will be implemented or not. There are reports on the network that as of February 19, 2015, “Kiva continues to lead the company as president of State Enterprise Antonov. This decision was made in accordance with the order of Aivaras Abromavicius, Minister of Economic Development and Trade. It is this ministry that State Enterprise Antonov reports to, since the Ministry of Industrial Policy, to which the enterprise was previously subordinate, was liquidated at the beginning of 2014,” wrote an unknown user on the LB.ua website.
On the official website of the Antonov State Enterprise, Dmitry Kiva is currently listed as the president and general designer of the enterprise. The press service of the Ministry of Economy and Food declined to comment on this matter over the phone. Let us recall that the Ministry of Industrial Policy appointed Sergei Merenkov as acting president-general designer of the Antonov State Enterprise from August 1, 2014, removing Dmitry Kiva from his post. On the same day, the Antonov aviation concern announced an attempt to raid the enterprise. It was noted that 16 unknown, strong people, led by Marenkov, broke the turnstiles at the entrance and illegally entered the territory of the enterprise. Security, Antonov’s “Self-Defense” detachments and enterprise workers were able to oust the unknown persons from the territory of the enterprise.
