In the Makhachkala pre-trial detention center, confession became the queen of extortion

In the Kirovsky District Court of Makhachkala, the former head of the local pre-trial detention center Daud Davydov, two of his subordinates, as well as the convict, who, in collusion with them, participated in extortion, were sentenced. The charges included abuse of power, bribery, extortion and fraud. The defendants denied all charges, but most of them were found guilty.

The high-profile criminal case has been heard in court since February 2021. In March, at the request of the defense, which found numerous violations of the Code of Criminal Procedure in the indictment, the materials were returned to the prosecutor for correction of errors. The new process started in the autumn of the same year. In many ways, the hearings dragged on due to the absence of witnesses.

According to its results, Daud Davydov was sentenced to eight years in prison, and his subordinates – the former head of the day shift of the regime and supervision department of SIZO-1 Makhach Vakilov and the senior inspector of the regime and supervision department of the detention center Abdulla Mirzaev – to five and a half years each. They must serve their sentence in a penal colony, said the head of the press service of the Supreme Court of the Republic, Zarema Mamaeva.

According to the case file, from December 2015 to June 2019, the defendants, repeatedly using physical violence against one of the prisoners, forced him to re-register the ownership of a land plot, buildings and an apartment – all this property was estimated at more than 5 million rubles.

The investigation also stated that the defendants received bribes from the victim’s wife totaling 150,000 rubles. Another 300 thousand rubles. were received from a local resident – for improving the conditions of detention of his father. And in February 2019, those accused of colluding with the convict stole 3.2 million rubles. at the prisoner.

During the debate, the state prosecution requested for Mr. Davydov 13 years in prison to be served in a strict regime colony with deprivation of the right to engage in certain activities for three years, a fine of 150 thousand rubles. and imprisonment for two years.

Makhach Vakilov and Abdulla Mirzaev should have spent nine years in prison, according to the public prosecutor. For the fourth defendant, convicted Rustam Rustamov, the prosecution requested seven years in prison, but the court imposed a more severe punishment for extortion in order to obtain property on a large scale – seven and a half years in a strict regime colony.

The former employees of the pre-trial detention center were saved from longer terms by the fact that the court acquitted all three on charges of one of the two episodes of extortion (extortion of ownership of real estate) due to the absence of corpus delicti in their actions.

The court also ruled that Daud Davydov should be acquitted on both counts of taking a bribe due to the lack of sufficient evidence to establish the corpus delicti.

According to investigators, along with Mr. Rustamov, Sultan Magomedshapiev, accused of murder, also participated in extortion from one of the prisoners, but he was later acquitted by the jury and, having been released, went on the run.

The defense plans to appeal the verdict.
