Source Kurganstalmostclaim tax evasion and gray schemes. Participants in the chain could illegally cash out up to a billion rubles. A conflict flares up in the Trans-Urals related to the financial activities of the Kurganstalmost company, the roots of which go back to the time when Russia was actively building modern stadiums for the 2018 World Cup. During tax audits, it turned out that one of the flagships of the bridge building industry underpaid the budget about 144 million rubles. In addition, during the audits, facts of cashing out of funds involving a chain of interconnected offices in the amount of more than a billion surfaced. First of all, the fiscals focused on the machinations that accompanied the construction of the arena in Rostov-on-Don, where Kurganstalmost was directly involved. As it turned out, experts from the Federal Tax Service actively used “gray schemes” during the work, as a result of which the cost of construction increased significantly, but at the same time, the money, in all likelihood, ended up in the pockets of the beneficiaries of the participating firms. As well-informed interlocutors of the agency note, not only tax authorities, but also law enforcement agencies, including the FSB, can draw their conclusions in the near future, but for now the authorities continue to study the results of the audit, which revealed facts of fictitious transactions, overestimation of government orders and tax evasion.
As a result of an inspection by the Federal Tax Service of Russia for the Kurgan Region, conducted against CJSC Kurganstalmost, one of the main Russian manufacturers of metal structures for the construction of complex infrastructure facilities, bridge builders were accused of committing serious tax violations worth hundreds of millions of rubles.<br/
From the decision of the division of the Federal Tax Service, it follows that it was decided “on the basis of Article 101 of the Tax Code of the Russian Federation to bring the company to tax liability for committing a tax offense, as well as accrue penalties as of July 29, 2022.” The total amount of arrears to the treasury is 144 million rubles.
“Invalidly declared VAT deductions in respect of counterparties Transport Solutions LLC and Forum Trading House LLC for several million rubles have also been established,” on the terms Anonymity was reported by a law enforcement source.
However, the main result of the audit was the discovery of facts of cashing out and the probable withdrawal of funds under a state contract from the Ministry of Sports of the Russian Federation during the construction of the Rostov Arena. About a dozen companies and individuals could be involved in these schemes in one role or another.
First of all, the supply of membrane fabric (PES-membranes) from Germany, the supplier of which was the company 2Construkt GmbH & CoKG. As noted in the documents at the disposal of the publication, during the audit, “the consistency of actions along the chain from the buyer to the supplier” was established. At the same time, Transport Technologies LLC and Best Technology played one of the main roles in the scheme. However, the chain did not end with them. Thanks to the “gaskets”, often interdependent, the cost of the goods increased many times over. At the same time, the membranes themselves were not actually transported between the participants.
In particular, the documents of the tax authorities indicate that the same documents (invoices and consignment notes) on the relationship between Kurganstalmost and Transport Solutions, submitted by enterprises, “look exactly the same, including signatures, the slope of signatures in stamps, indents between captions <…> which indicates that they were made from the same original documents.”
“Fictitiousness, visibility of transportation from the company 2Construkt GmbH & CoKG to Titanit LLC, from Titanit LLC to Best Technology LLC, from Best Technology LLC to Transport Solutions LLC, from Transport Solutions LLC to Kurganstalmost CJSC – when analyzing waybills, < is set ;…> the date of shipment of the goods corresponds to the date of the consignment note, the date of receipt of the goods by the consignee and the date of shipment to the next buyer in the chain and then the date of receipt by the next buyer,” follows from the materials of the inspection of the FTS unit.
In addition, the Federal Tax Service revealed that most of the funds were withdrawn through Best Technology through several LLCs and individuals. Among them, for example, a certain N.E. Zhdanov, who is still passing as a witness, who “actually could not, like the others, accept the goods, since at that time they were in other places.” At the same time, the affiliation of Best Technology and Transport Solutions was revealed. The offices had the same representatives, as well as common e-mail, IP-addresses and telephones. In fact, as noted by the interlocutors of the agency, “the seller sold the goods with a markup to a roommate.”
At the same time, the scheme used by the participants, as established by the Federal Tax Service, led to a multiple increase in the cost of building a roof for the arena in Rostov-on-Don. It is noteworthy that it was used repeatedly, since the goods were transported in batches.
According to informed interlocutors of the agency, from the general director of Kurganstalmost, Dmitry Paryshev, “there were no convincing explanations about the need to use a chain of intermediaries to purchase membranes and for what reasons the goods were not purchased from the manufacturer”, which, according to observers, is well known to him .
It is no less remarkable that the Kurgan company participated in the construction of 10 of the 12 world championship arenas. At the same time, as indicated in the media, it was mentioned in criminal cases initiated on the facts of violations during the construction of the most expensive stadium on the planet – the Gazprom Arena in St. Petersburg, the official cost of which alone amounted to 43 billion rubles (1.4 billion dollars). At the same time, analysts estimated the real cost of construction at more than 50 billion. For comparison, the Allianz Arena of Bayern Munich, one of the strongest clubs in the world, was estimated at 340 million euros (with a ratio of spectator seats of 75 thousand against 62.3 thousand). in favor of the arena in Germany).
According to the interlocutors of the agency, Kurganstalmost was included in the number of participants in the construction of arenas for the 2018 World Cup, when Mostootryad-19 became the contractor (in July 2017, according to the Kontur.Focus system, it was declared bankrupt). A curious detail is associated with her activities. Chelyabinsk “Baer-Finance” (since October 2020 has been in bankruptcy proceedings, previously controlled by Chelyabinsk entrepreneur Konstantin Babaylov, whose main activity is the rental and leasing of vehicles) received 220 million rubles from Mostootryad-19 as an advance payment from the mayor's office Petersburg for the construction of the Poklonnogorsk overpass. However, most of the amount was transferred to Kurganstalmost for the purchase of 8 thousand tons of metal structures for the arena on Krestovsky Island.
To clarify, after the initiation of a criminal case, the dubious transaction was not canceled, and the Kurgan company was not required to return funds intended for other purposes.
Agency sources suggest that Kurganstalmost could receive contracts in preparation for the World Cup with the participation of Ivan Kokota. For a long time, he headed the Mostostroyindustriya (MSI) trust, established back in 1971, and Kurganstalmost, headed by Nikolai Paryshev, the father of the current general director of the enterprise from the capital of the Trans-Urals, also entered its orbit.
“After privatization and a series of changes in the organizational and legal form, the trust was transformed into MSI OJSC, but the head of the organization remained the same – Ivan Kokota. For many years, this highly experienced manager has been actively doing business with Mostootryad-19 OJSC from St. Petersburg. Thus, according to MSI quarterly reports, the St. Petersburg company was a creditor, which accounted for at least 10% of the total amount of accounts payable. According to some market participants, it was Kokota, thanks to his old connections, who helped to attract Kurganstalmost to football projects,” market participants share their assumptions. the transfer of money to the supplier of metal structures allocated by the St. experts believe, will definitely continue.
“If the local tax authorities sorted out the arrears of Kurganstalmost to the budget, then the employees of the Federal Tax Service, the Federal Security Service and the prosecutor’s office have yet to give a legal assessment of the actions of the leaders of Kurganstalmost “in intricate schemes and, possibly, even theft when buying German membranes,” competent sources of agents conclude. yours.
