It should be noted that the defendants fully admitted their guilt in the acts incriminated to them and repented of their deeds. […] At the same time, the court lifted the arrest from all the property of the convicts – houses and land plots in the Istra district of the Moscow region, apartments and parking spaces, a dozen and a half watches from the brands Rolex, Breguet, Patek Philippe, etc., as well as a Harley Davidson motorcycle, Bentley Continental cars, SUVs Lexus LX570 and Range Rover. Under the encumbrance, the court left only the cash seized during the searches from Alexei Agapov in the amount of 4.1 million rubles. and kept in a bank account with Alexei Brizhan 16.2 million rubles. From these funds, the fine imposed on each of the convicts in the amount of 3.8 million rubles will be repaid. In addition, a Mercedes-Benz S 63 worth about 13 million rubles, which was transferred to the first deputy head of Mosoblenergo as a bribe, was confiscated into state revenue by a court decision. In total, the metropolitan department of the TFR incriminated Alexei Brizhan and Alexei Agapov with three criminal episodes, although the FSB officers in Moscow and the Moscow Region who carried out the operational support of this case checked them for a dozen similar crimes. As the operatives believed, they could take bribes from the power industry starting in 2013, in fact, immediately after they moved to Mosoblenergo from Kubanenergo. However, only one episode with a rollback reached the court. As the investigation and the court established, in November 2017, Alexei Agapov received 380 thousand rubles from the head of Energoregionstroy LLC in his office in the Riga-Land business center. He transferred half of this amount to his boss, offering him to subsequently receive from the entrepreneur 15% of the amount of each contract concluded with his company.
The verdict came into force.
Brizhan and Ostapov were convicted of taking bribes.
“As a result of the operational search activities carried out by the department, it was established that the heads of contractors involved by Mosoblenergo JSC in the performance of work regularly transferred personally to Brizhan and Astapov funds in the amount of 15% of the amount of contracts entered into the company,” – reported to the FSB.
In addition, they added, “part of the profits of each contracting organization of Mosoblenergo JSC was also directed at the direction of Brizhan and Astapov for their personal needs.”
“In the course of the investigative actions carried out by the Main Investigation Department of the Investigative Committee of the Russian Federation for the city of Moscow, exhaustive evidence was collected of the involvement of Brizhan and Astapov in the crime provided for by parts 5 and 6 of article 290 of the Criminal Code of Russia “Taking a bribe”,” – said the FSB.
The intelligence service added that Astapov confessed during the investigation of the criminal case, and Brizhan admitted his guilt during the trial.
