The District Administrative Court of Kyiv canceled the order of the Ministry of Culture and the Department for the Protection of Cultural Heritage of the Kyiv City State Administration on entering the Flowers of Ukraine pavilion into the register of monuments, which prohibits its destruction or rebuilding, writes EP.
This is stated in the court ruling of December 2 .
“…Recognize as unlawful and cancel the order No. 801/6.11.6 issued on July 13, 2021 by the Ministry of Culture and Information Policy of Ukraine on the termination of construction work at the facility “Reconstruction of an integral property complex with a superstructure for accommodating an office center with underground parking on the street . Sich Streltsy, 49 in the Shevchenkovsky district of Kyiv”;
declare illegal and cancel the order of the Department of Cultural Heritage Protection No. 46 dated July 29, 2021;
recognize as illegal and cancel the order Ministry of Culture and Information Policy No. 625 of August 06, 2021,” the court ruling says.
As explained in the NGO “Preserve Flowers of Ukraine”, the court of first instance – OASK – explained the abolition of the status by the fact that “the building of modernism is the Soviet Union, the project of the developer (which does not exist) corresponds to European standards (whatever that means), the Ministry of Culture and DOKS they are at war with private business, and the decision to grant the status is incompetent and biased.”
“OASK competently decided that Flowers are “an object of Soviet times, in a state that does not add aesthetic beauty and value to the historical appearance of Kyiv”, – they say in the OO.
This means that “Flowers of Ukraine” is no longer a monument, it does not have a protected status, the developer is no longer subject to the order of the Ministry of Culture to ban construction work, the NGO “Preserve Flowers of Ukraine” notes.

“The consideration took place very quickly and according to a simplified procedure, therefore, the participants in the case did not even have to be informed about this. We only found out because we were following,” the NGO’s position reads.
The public organization called on the Ministry of Culture and the Department for the Protection of Cultural Heritage of the Kyiv City State Administration to file an appeal and express their official position regarding these events.

In August 2021, the Ministry of Culture and Information Policy entered the Flowers of Ukraine building, which is located in Kyiv, into the register of state monuments, which prohibits its destruction or reconstruction.
In July, in the center of Kyiv, on Sichovykh Streltsy Street, they began to demolish the modernist facade of the educational and methodological pavilion “Flowers of Ukraine”.
Subsequently, the Shevchenkovsky District Court of Kyiv banned the owner of the “Flowers of Ukraine” building from dismantling for a while litigation on violation of the architect's non-property copyrights.
In early August, the Department of Cultural Heritage Protection, by its order, added the Flowers of Ukraine building to the list of cultural heritage sites in Kyiv.
