Without a jury and with the judge, who the day before passed a sentence on Rashid Dzhambulsky, this is how the trial of the alleged members of the Tukaevsky gang started today. There are 7 people in the dock, who are accused of brutal murders on the basis of the redistribution of criminal influence. The prosecution considers Gennady Kirilov to be the leader of the group – for him this is the second criminal case against Tukaevsky. How Tukaevskiye started
One of the most high-profile criminal cases of the year started today in the Supreme Court of Tatarstan. There are 7 people in the dock, whom the investigation and prosecution consider involved in several crimes: murders, attempted murder, kidnapping, illegal possession of weapons and banditry. All crimes, according to investigators, were committed back in the heyday of the “Kazan phenomenon”, at the turn of the 90s – zero.
The most “famous” among the defendants in the case is Gennady Kirilov, whom the investigation considers the leader of the Tukaevsky gang. He is charged with the most serious articles: the creation of an armed gang (part 1 of article 209 of the Criminal Code of the Russian Federation), as well as the organization of three murders and an attempt, for which he can face up to life punishment. Kirilov is in jail. His external image is dissonant with the crimes that he is charged with: he looks like an intelligent man with a well-delivered speech, wears glasses for vision, and even appeared in a jacket at the court session.
Answering the questions of judge Airat Ibatullin, who only yesterday sent thief in law Rashid Khachatryan (Dzhambulsky) to prison, Kirilov said that he is 54 years old (he is the oldest of all the defendants), he has a higher education, has a wife and two adult children . He introduced himself as the commercial director of Stroytekhnika LLC: according to Spark Interfax, Kirilov is a co-founder of this company, its co-owner is Nail Shaikhutdinov. In criminal circles, the latter is known as Nelson, he is a defendant in the first criminal case of the Tukaevsky organized criminal group, which returned to the prosecutor’s office. Nelson’s name does not appear in the new case.
The other five defendants in the criminal case modestly huddled in another, nearby aquarium – since the large hall of the Supreme Court of the Republic of Tatarstan allowed this. Among them are 51-year-old Airat Ayupov, 45-year-old Ilnur Kiyamov and Rustem Sharafutdinov, 47-year-old Alexander Marfin and Airat Abdrakhmanov, and 45-year-old Albert Kazakov. Abdrakhmanov is the only one of the defendants who is not in custody: he participated in the court session, sitting in a comfortable chair in the hall, and then left the session on his own.
Kirilov’s lawyers, Alina Bogateeva and Anna Garipova, insisted on postponing the hearing, because they had not fully studied the case: it contains 35 volumes (including five volumes of the indictment), which they had not had time to read in a month from the moment they entered into court. case. However, taking into account the fact that all participants in the meeting were determined to work as fruitfully as possible, they did not postpone the process: they decided that after the prosecutor announced the essence of the charge, the lawyers would be given time to read the case.
How the Tukaevskiye gang appeared and developed
State prosecutor Elina Ilyasova told the court in detail what the defendants are accused of. The story goes back to the 80s. According to the investigators and the prosecution, the Tukaevskiye group existed at that time on the territory of the Vakhitovsky district – an “association of teenagers” who gathered “to commit hooligan and other illegal actions” against the same groups. The prosecution believes that the group was led by a certain Akhmetshin (probably, we are talking about Radik Akhmetshin, nicknamed Hitler). By the early 1990s, the active members of the group were Akhmetshin, Baranov, Kirilov, Kadyrov, Valitov, Ilyin, Sultanov, Ayupov, Lukoyanov, Shagiev, Shaikhutdinov, Nigmatzyanov, Nafikov, Danilin, Saifullin, Minullin and “other persons,” the prosecutor listed, naming for speed only surnames.
By that time, the Tukaevskys controlled the central market and individual entrepreneurs who worked nearby. These are, for example, Idel, the Jacqueline trading house, Srednevolzhsky transnefteprodukt, and others. “Unified the most active participants under his leadership and transformed the group into an” organized group of criminal orientation, “which also became known as” Tukaevsky “. It included all those whose names were mentioned above, they also controlled the so-called youth, or, in the language of the state prosecution, “the Tukaevsky youth group.”
What connected the alleged members of the organized crime group? They all lived side by side, studied at the same schools, spent their free time together, went in for sports, and were united by one goal – “to achieve criminal domination among the criminal gangs of the city of Kazan with the aim of subsequent personal enrichment.” All participants used “Obshchakovsky” transport: “Volga”, various “VAZs”, etc.
At some time, Akhmetshin realized that there were people inside the group who could interfere with his plans, because they themselves claim leadership. Then, according to the prosecution, he gathered around him the closest people and armed them – this moment in the indictment is interpreted as the creation of an armed gang inside the organized criminal group, and with the same name – “Tukaevsky”. The gang included Kirilov, Kadyrov, Valitov, a little later – Ilyin, and in the early 2000s – Ayupov, Aidarov and “other unidentified persons.” The weapons used by the defendants were stored in a safe installed in the production room at house No. 91 on Tukaya Street, the investigation established.
“Thus, the organized Tukaevskiye group consisted of members of the gang and persons not included in it,” the prosecution reads.
But Akhmetshin did not lead the “armed gang” for long, only three months, from January to March 1993, until he was shot dead. The prosecution believes that Kirilov became the leader instead. The prosecution believes that the roles in the gang were strictly distributed. Kirilov, being the leader, decided who and how would be attacked, who would be taken “under the roof”, and gave instructions to the gang members, and also distributed the “earned money” among them.
The rest – Kadyrov, Valitov, Ayupov, Khaidarov and “other persons”, as well as Kirilov himself before he became the leader after the murder of Akhmetshin – were active members of the gang who followed the instructions of the leader. There was a “mutual responsibility” in the gang, strict discipline, hierarchy, conspiracy, and also the principle of categorically not interacting with law enforcement agencies.
The gang existed for almost 10 years – from January 1993 to April 2002, the prosecution believes. “The armed group that was created posed a real threat both to the personal security of citizens and their property, and to the normal functioning of state and commercial organizations,” this is how the activities of the Tukaevskys, who were under investigation only 20-30 years after they were arrested, are described. posed a threat.
What are the alleged members of the Tukaevskiye organized crime group accused of?
After the “introductory” part, the state prosecutor moved on to specific crimes charged to the defendants.
The first episode: the murder of businessman Sadykov in 1993. According to investigators, at the beginning of 1993, Sadykov, whose business was “protected” by the Tukaevskys, said that he had decided to get out of their control. Akhmetshin, who was then alive, and Kirilov did not like it. The businessman was called for a conversation, but he did not change his mind. Then Akhmetshin allegedly instructed to kill the intractable businessman, and Kirilov to carry out the murder. He, in turn, attracted Kadyrov and Valitov to the “order” (they do not appear in the criminal case), with whom he often went to the bathhouse at the “Health Plant”. They agreed. On January 24, 1993, Kadyrov ambushed Sadykov at his entrance to house number 9 on Chuikov Street and, having waited for him, shot him in the face. The man died. Kadyrov threw the weapon away right at the entrance, ran out into the street, got into Valitov’s car and left.
Kirilov is accused of this crime: the state prosecutor read out that this is Art. 102 of the Criminal Code of the RSFSR – organization of premeditated murder.
The second episode: the murder of a member of the Baranov group in 1997. According to the prosecution, Baranov was an active member of the Tukaevskie organized crime group and at some point began to claim leadership. Against this background, a conflict occurred between him and Kirilov. Baranov, in turn, gathered the members of the group, whom he threatened with a revolver – they say, either you choose me, or there is no other option. Kirilov decided that Baranov should be eliminated, according to the investigation. He entrusted the “order” to a member of the “Tukaevsky” Ilyin, who attracted the killers – their investigation did not establish. As a result, Baranov was shot in the head, he died in his own house on the street. Gabisheva, 19.
Kirilov is accused of this crime.
The third episode: the attempted murder of the former director of the KSK UNICS Alexander Shcherbakov in 1999. According to investigators, the group wanted to “protect” Alexander Shcherbakov’s business: in addition to managing the sports complex, he also rented out premises, etc. Because he understood that the business was not bad, profitable, and the entrepreneur did not share money. The proposal was voiced to Shcherbakov, but he refused. Then Kirilov decided to act by force and ordered the murder of Shcherbakov. Rinat Farkhutdinov (Rintik, killer “Khadi Taktash”) took up the case for $10,000. He, in turn, handed over the task to Novitsky, and together they went to fulfill the “order”. Shcherbakov was tracked down after work when he left UNICS and got into his car. The prosecution believes that Novitsky fired several shots at Shcherbakov through the windshield and the front door and ran away, got into Farkhutdinov’s car and left. Shcherbakov miraculously survived – he had wounds to his chest, shoulder, forearm, thigh …
Kirilov is accused of this crime.
The fourth episode: the murder of Ayupov in 2002 (the prosecution does not name the murdered person, however, according to our information, we are talking about the murder of the leader of the Pervaki organized crime group, Robert Ayupov). According to investigators, a financial conflict arose between the groups. Having learned that Ayupov was allegedly hatching plans to kill the Tukaevskys, the latter decided to act proactively. Ayupov was shot in his car in broad daylight near house number 4 on Academician Parin Street. Several bullets were fired at him at once, some of which went right through.
Kirilov, Ayupov and Kiyamov are accused of this crime.
Fifth episode: the murder of Garipov, a member of the Novotatarskie organized criminal group, in 1997. According to investigators, at the end of the 90s, another gang was formed inside the Tukaevsky gang, which was called the Danilovskys – after the leader, Danil Safiullin. There was a conflict between the Danilovskys and the Novotatarskys, and the former decided to kill Garipov. They grabbed him right on the street, put him in a car, locked him in the attic of the house, where they beat him until he died. In the evening, the corpse was taken out by car and thrown out on the territory belonging to the Novotatarskys – they threw out the bloody body near the city hospital on Sharif Kamal Street.
Kazakov, Sharafutdinov, Abdrakhmanov, Ayupov and Marfin are accused of this crime.
Sixth episode: illegal possession and carrying of weapons. The gang, according to the investigation and the prosecution, had a whole arsenal of weapons – this was a sawn-off shotgun, and various pistols that were stored in a safe.
Kiyamov and Ayupov are accused of this crime.
Why no jury
Initially, Kirilov filed a petition for a trial with the participation of a jury. This issue was considered at a preliminary court session, behind closed doors. Today, however, it turned out that there would be no jury.
According to lawyer Kirilov Garipova, they considered a jury trial in this case inappropriate. “There are a lot of questions about the very procedure for collecting evidence in a criminal case, and only a judge can consider this issue,” Garipova explained. – The main emphasis of the defense side is that a lot of evidence is fabricated. But we cannot investigate this issue in front of a jury.”
She also spoke about Kirilov’s attitude to the criminal case. “He believes that this criminal case was fabricated against him as revenge for being the main witness in the case against (ex-head of the BOP Ilnar) Zalyalov. After that, they began to take revenge on him. He not only sees (a direct causal relationship), he was repeatedly informed about this behind the scenes, ”said the lawyer.
At the next meeting, which will be held in mid-May, the judge will find out from the defendants in the case whether they plead guilty, and then determine the procedure for examining the evidence – it is possible that the victims will be interrogated first.
