02/22/2023 The Economic Court of Kyiv partially satisfied the claim of DTEK Zakhidenergo JSC against Ukrenergo (in the case No. 910/9214/22) and decided to recover UAH 945.5 million from the defendant in favor of the plaintiff, reports Finbalance.
According to court materials, the plaintiff referred to the defendant’s failure to comply with the terms of the agreement on participation in the balancing market in terms of payment for balancing services for February-May 2022.
How wrote Finbalance, 07/26/2022 The Economic Court of Kyiv partially satisfied the claim of DTEK Zakhidenergo against Ukrenergo (in case No. 910/18611/21) and decided to recover from the defendant in favor of the plaintiff UAH 438 million of debt for electricity received in December 2021 on the basis of an agreement on participation in the balancing market.
On 07/26/2022, the same court partially satisfied the claim of DTEK Vostokenergo against Ukrenergo in another case No. 910/18613/21 – and decided to recover from the defendant in favor of the plaintiff UAH 202 million of debt for electricity received in April 2 from the agreement on participation in the balancing market.
On July 13, 2022, the Northern Economic Court of Appeal refused to satisfy the appeal of Ukrenergo and upheld the decision of the Kyiv Economic Court dated February 22, 2022 (in case No. 910/18639/21), which satisfied the claim of DTEK Dneproenergo from the defendant in favor of the plaintiff UAH 412 million. debt under the agreement on participation in the balancing market in terms of payment for the balancing electricity purchased from DTEK Dneproenergo in the period from April to October 2021.
02/08/2022 The Supreme Court refused to satisfy the cassation appeal of Ukrenergo in case No. 910/6635/21 and left unchanged the decision of the Northern Economic Court of Appeal dated 10/11/2021 and the decision of the Kiev Economic Court dated 07/05/2021, which partially satisfied the claim of DTEK Dniproenergo, and decided to recover from Ukrenergo 399.4 million UAH of debt, which was formed from – for improper fulfillment by the state company of obligations under the agreement on participation in the balancing market (for the period from 09/10/2020 to 04/20/2021).
On 06/15/2022, the Supreme Court refused to satisfy the cassation appeal of Ukrenergo and upheld the decision of the Northern Economic Court of Appeal of 12/08/2021 and the decision of the Kiev Economic Court of 09/06/2021 (in case No. 910/6639/21) DTEK Zakhidenergo to Ukrenergo and it was decided to recover from the defendant in favor of the plaintiff UAH 1.32 billion of arrears in payment for electricity on the basis of an agreement on participation in the balancing market.
06/08/2022 The Supreme Court refused to satisfy the cassation appeal of Ukrenergo in case No. 910/6636/21 and upheld the decision of the decision of the Northern Economic Court of Appeal dated 09.11.2021 and the decision of the Economic Court of Kyiv dated 15.07.2021 “DTEK Vostokenergo” to “Ukrenergo” and it was decided to recover from the defendant in favor of the plaintiff 633 million UAH of debt arising from the improper fulfillment of obligations by the defendant under an agreement on participation in the balancing market.
In September 2022, Ukrenergo reported on the payment of UAH 3 billion to participants in the balancing electricity market (at the expense of the state company’s income from the sale of interstate crossings for export).
