Source Belonging to thieves in law proved by tattoos. The Moscow prosecutor's office approved the indictment in a criminal case against 50-year-old David Chachibai (aka David Gerliani and Dato Swan). The thief in law is accused of racketeering and occupying the highest position in the criminal hierarchy. According to Kommersant, one of the proofs of Dato Svan's connection with the criminal world was a cultural examination of tattoos on his body.
David Chachibaya is accused of committing crimes under Art. 210.1 of the Criminal Code of the Russian Federation (occupation of the highest position in the criminal hierarchy) and paragraph “a, b” part 3 of Art. 163 of the Criminal Code of the Russian Federation (extortion committed by an organized group, on an especially large scale).
It has been established that Chachibaya was crowned thieves in law remotely back in 2014.
By video link, other lawyers recognized the authority of Dato Svan, who is in Turkey, who was assigned a “zone of criminal influence” in the institutions of the penitentiary system located in Moscow, St. Petersburg, as well as in the Moscow, Smolensk, Ulyanovsk and Leningrad regions. Assigning himself to the category of so-called thieves in law, the prosecution says, using unconditional authority among persons adhering to a criminal ideology, observing and promoting criminal traditions and customs, he obliged other persons in the criminal environment to obey his will, appointed so-called officers who were under his full patronage and, acting according to the customs of the criminal world, carried out various assignments and instructions.
After being placed in pre-trial detention center No. 7 of the Federal Penitentiary Service of Russia in Moscow in May 2022, during an inspection by the inspector on duty of the detention center, Chachibaya informed him of his criminal status, “confirming his occupation of the highest position in the criminal hierarchy.”

According to cultural expertise, the tattoos on his body “carry information” about being in prison, about a tendency to antisocial behavior, denial of the order established by the administration and rules of the correctional labor institution, generally recognized norms and rules, as well as involvement in criminal authorities and thieves in law, that is, persons occupying the highest position in the criminal hierarchy.
Based on the semantic meaning of the “permanent drawings” applied to the body of Dato Swan, he may have the highest status in the criminal environment.
It was also established that Chachibaya organized and led a criminal group whose members in 2020, threatening the life and health of the victim and his family, extorted 15 million rubles from him under a far-fetched pretext. One of the accomplices in the crime was detained by law enforcement agencies while transferring 10 million rubles.
During the investigation, a measure of restraint in the form of detention was chosen against Dato Swan in absentia, and he was put on the international wanted list. A lawyer was detained in Egypt. In March 2022, the Prosecutor General's Office of Russia filed a request for the extradition of a criminal authority, which was granted in May. The authority was brought to the capital and placed in a pre-trial detention center.
The criminal case of Dato Svan will be considered by the Moscow City Court.
