Owners of elite cottages in the Maetok complex near Kyiv will be evicted
The lawsuit against the Maetok cottage complex, which Finbalance wrote about, is taking on an interesting new development.
Recall that more than 37 elite cottages and land plots of the Maetok cottage complex (in the villages of Ivankovichi and Roslavichi near Kyiv) were withdrawn from the mortgage of the state-owned Ukreximbank due to an illegal auction scheme in the bankruptcy procedure. The Supreme Court invalidated such an auction, and, as a result, all these cottages and land plots are subject to reclaim from the current owners, return to the property of the bankrupt and to the bank's mortgage for resale as part of the bankruptcy procedure. In return, the current owners of this property may be entitled to submit their claims for compensation of the value of the property to the organizers of this scheme.
The bankruptcy case of the Construction Ukrainian Union LLC has been going on for more than 10 years, the state-owned Ukreximbank has not received a single penny in this process over the years. This is a separate evidence of gaps in the Code of Bankruptcy Procedures and the inefficiency of the judicial system in Ukraine and the Ministry of Justice, which cannot assess the inaction of the liquidator and properly control the bankruptcy process.
The statement of claim for the reclamation of residential buildings with land plots from 33 defendants finally arrived at the Economic Court of the Kyiv Region in this case. However, it is too early for Ukreximbank to lose vigilance regarding the actions of the liquidator of the company (S. Gorbach), who is the plaintiff in the said statement: the court, in its ruling dated 11/23/2022, stated that the arbitration manager did not send copies of the claims to the defendants. This may indicate an attempt by Mr. Gorbach not to disclose this statement, since the beneficiary of Construction Ukrainian Union LLC, Igor Kitskoy, to whom the defendants (33 current owners of cottages) are deprived of cottages in Maetok, is unlikely to be satisfied by filing such a claim, most likely all will have claims.
From the court ruling dated 11/23/2022, it is seen that among these defendants there are Odestorg LLC, Listvan LLC, Vitrus LTD LLC, StatusHouse LLC, the rest are individuals. On the official website of the “Judicial Power” under case number No. B8/065-12 (911/2359/22), in the auto-distribution report, you can see all the personalities, including business representatives, civil servants and even partners of the beneficiary of LLC “Construction Ukrainian Union” Igor Kitskaya.
From unofficial sources, it became known that at the end of October this year, the court satisfied a similar claim previously filed by Gorbach and demanded two land plots in the “Estate” from the current owner-individual.
That is, for the 33 defendants mentioned above, the prospect of being evicted from the cottages in Maetok becomes real.
