Bastrykin found flying moments in the aircraft factory business

According to informed sources, the appeal of the head of the Investigative Committee of the Russian Federation has already been sent to the Prosecutor General. State Duma deputy Olga Alimova is again seeking a fair trial for those responsible for the death of the aircraft manufacturing giant.

Having learned about the next refusal of the Prosecutor General’s Office for the Volga Federal District, the parliamentarian sent appeals to Prosecutor General Igor Krasnov and Deputy Chairman of the Security Council Dmitry Medvedev.

Legally CJSC Saratov Aviation Plant ceased to exist in 2012. The bankruptcy procedure was introduced at the enterprise twice, it was conducted by arbitration managers from the Penza SRO AU Liga. At the same time, the members of the “League” in violation of the law both headed the enterprise and dealt with its bankruptcy.

So, the representative of this SRO, Igor Sklyar, became the bankruptcy trustee in the first procedure, Oleg Fomin, who headed the League at that time, was the general director of SAZ for a long time, representatives of this SRO also sat on the board of directors. In the future, Sklyar and Fomin replaced each other in senior positions at the aircraft factory.

The total dominance of the “League” allowed its members to master the assets of the Saratov giant without the intervention of third parties, and the plant with an estimated value of 8 billion rubles, being sold in its entirety, failed to pay off the debt that began the story of its collapse. And the beginning of the end was a lawsuit against the plant from the company Gazkomplektimpeks in the amount of 335.9 million rubles. It was from him that the first bankruptcy started in 2005, during which the League’s supporters bought the right to claim the debt.

In the second bankruptcy (began in 2010), the entire debt of the enterprise increased to 1.033 billion rubles, during bankruptcy proceedings only 107 million rubles were bailed out. The tax inspectorate, as the plant’s largest creditor (over 800 million rubles), did nothing to influence the course of the procedure.

In 2009, in the interval between two bankruptcies, by decision of the shareholders’ meeting, the lion’s share of the company’s assets was transferred to two JSCs – Yuzhny Aerodrom and Razvitie. As a result of such a reorganization, 264 hectares of airfield land and a huge number of real estate objects left the enterprise – 33 land plots in Saratov, 68 buildings, non-residential premises, apartments.

However, after the official death of SAZ, by the decision of the arbitration court, the criminal case on the unlawful reimbursement of VAT, which featured, among other things, the lands of SAZ, was still “alive”. This case was conducted by the investigators of the Penza Investigative Committee of the Investigative Committee, thanks to their active position, the determination of the State Duma deputy Olga Alimova, as well as the support of the then deputy of the State Duma Valery Rashkin, the investigation materials were brought into a separate criminal case.

Criminal case No. 270016 was initiated on March 2, 2016 in the 3rd Investigation Department of the Investigative Committee of Russia on the grounds of crimes under Art. 196 (intentional bankruptcy), Art. 1 (failure to fulfill the duties of a tax agent).

A few years later, it served as an impetus for grandiose land restitutions: the sections of the aircraft factory, which the Penza businessmen had so cleverly taken over, triumphantly returned to the ownership of the Russian Federation. The trials began in 2018, and by 2022, through arbitration, almost 300 hectares of the territory of the SAZ and ten shelters of civil defense and emergency situations were returned to the country’s ownership.

Such a finale would have been unthinkable if it were not for the intervention of the speaker of the State Duma, Vyacheslav Volodin. The attention of a third party in the state to this high-profile story was attracted by SAZ veteran Alexander Bernadsky, as a result, at the initiative of Volodin, a working group appeared under the regional government, which included State Duma deputies, security officials, federal, regional and municipal officials. The group became an outpost of change, in which few people believed.

But, as it turned out, it is easier to return hundreds of hectares to the state than to bring clever arbitrators to court. The accused in case No. 270016 are the former general director of the plant Oleg Fomin (Art. 196, Art. 201, Part 2 of the Criminal Code of the Russian Federation), the bankruptcy trustee who conducted the first bankruptcy procedure Igor Sklyar (Art. 196, Art. 201 Part 2, as well as Art. .199.1 part 1 of the Criminal Code of the Russian Federation – failure to fulfill the duties of a tax agent in personal interests).

The third defendant is the “elusive” Oleg Tyugaev, a former member of the board of directors of ZAO SAZ. His case has been separated into a separate proceeding, he is wanted under Part 3. article 33 (organizer of the crime), article 196, article 201 part 2 of the Criminal Code of the Russian Federation. In 2019, Oleg Fomin and Igor Sklyar were awarded personal criminal cases under part 2 of article 201 of the Criminal Code of the Russian Federation (exceeding official powers with serious consequences).

Case No. 270016 contains 265 volumes, this huge array in 2023 went to the Office of the Prosecutor General for the Volga Federal District for the third time. The first attempt took place in 2021, the second in 2022. The administration must approve the indictment, but it has not been possible to overcome the prosecutor’s cordon even now.

Each time, the prosecutor of the district department of the Prosecutor General’s Office, Mikhail Tolstobrov, puts forward remarks. According to the sources of BV, the representative of the supervision either fails to see a causal relationship between the acts of Fomin and Sklyar and the bankruptcy of the enterprise, then the prosecutor points to the expiration of the investigation, then puts forward formal remarks.

Every time the investigators conscientiously work on these objections, conduct examinations, but history moves in a vicious circle.

“It’s as if it’s very important for someone that Sklyar and Fomin don’t sit in the dock,” comments State Duma deputy Olga Alimova. – The huge plant was brought to complete collapse, hundreds of families of aircraft builders were left without work, the budget received less than 800 million rubles in taxes, the country’s defense capability was dealt a huge blow – and nothing! Hundreds of thousands of our countrymen know the tragic history of SAZ, they know that he forged the Great Victory, they know how much he did for the development of aviation. Therefore, we all demand justice!

According to the State Duma deputy, the situation with the criminal case in general runs counter to current trends in Russia:

– The first persons of the country pay great attention, they constantly come to enterprises, visit the workshops in which our victory in the special operation is forged. The cases of “effective managers” who ruined factories are finally being given a fair assessment. But in our case, we see something completely different. But for us, this is not just a resonant matter, it is a matter of principle!

Help “BV”. According to the investigation, stated on the official website of the TFR, in 2009, the General Director of CJSC Saratov Aviation Plant Sklyar and the Chairman of the Board of Directors of the enterprise Fomin withdrew the liquid property of the plant at a reduced cost, and also created artificial accounts payable, which led to the bankruptcy of the enterprise and causing material damage in the amount of 895.8 million rubles. In addition, Sklyar failed to fulfill his duties as a tax agent of CJSC Saratov Aviation Plant in transferring personal income tax calculated from the wages of the plant’s employees to the budget in the amount of 41.3 million rubles.
