Argo is buying up objects with the money of Promsvyazbank in the interests of long-term construction at the address 5th Donskoy proezd vl. 21 to 6?
Advertising is sometimes the engine of deception. This sad fact was fully experienced by those who once invested in future luxury real estate at 5th Donskoy proezd vl. 21d6. Years flew by, and the residential complex “Neskuchny HOME & SPA”, advertised in the pictures of 5 skyscrapers, did not appear in reality.
LCD “The Five” took over from him, at the same place, with the same developer, only changed its name – SZ “5 Donskoy” LLC, and with a new project: instead of five skyscrapers – one.
Again, pictures flashed on the Internet, inviting investors, equity participants in the construction to buy “elite” square meters in the skies. “Premium complex”emphasizes the advertisement.
It is not known why on sales sites they continue to draw five skyscrapers, and not one … For coolness, I guess. But, by the decision of the city, the investment project, which included five skyscrapers on the site of existing multi-apartment brick buildings, was terminated back in 2021.
Since May 2023, a monitoring procedure has been introduced in relation to the main investor of the Neskuchny HOME & SPA Residential Complex project (the founder of the developer – Kompleks-Stroy LLC) in an insolvency (bankruptcy) case.
The government agencies, which suspended the construction until 2021, subsequently nevertheless gave permission, despite the financial scandals around the developer, to build one skyscraper, but not five!
The site for a 75-storey skyscraper with 640 apartments is only 0.3 hectares. Therefore, the construction site, as you can see, is literally “scraping” neighboring residential buildings, as it stuck close. From the windows to the arrows of cranes within easy reach. According to experts, the skyscraper monster in the future may violate the sanitary and epidemiological requirements for the so-called normative insolation of living quarters in neighboring houses. In simple words, it will close the sunlight to the inhabitants of the quarter.
Residents of 5th Donskoy proezd are sounding the alarm – in the Tverskoy District Court they are challenging the positive conclusion of the design documentation for the residential complex “The Five”, issued to the developer by Mosgosexpertiza, they are complaining to the competent authorities about violations by the developer of the boundaries of the land leased for construction.
Everyone has this building in the liver. It began in 2016, without rising above 1.5 floors, was stopped due to multiple violations of urban planning legislation by the developer and its financial problems, disagreement of the residents of houses that fell into the development spot with the upcoming resettlement.
And now everything here is still at the stage of a “concrete pit”. Residents have created a website “Let’s Protect the 5th Donskoy!”, where they post facts that they observe with their own eyes with pain.
On the official portal for checking new buildings of the EIIHC “Our House. RF “there is evidence that the next deadline for the planned completion of construction at the address 5th Donskoy proezd, vl. 21, k.6 is increased from the originally declared date by as much as 6 years 11 months 30 days! Such, here, “new building” …
Who benefits from endless long-term construction? Residents were puzzled by the question – at whose expense is this “banquet”? It requires a lot of money. The “construction pit” may well become a financial pit, where new players will fall in love.
The developer, of course, tried to attract funds from individuals – participants in shared construction. This was the purpose of the advertising campaign. However, according to the same site “Our House. RF”, so far 8 percent of the apartments have been sold. Won’t it turn out that in the finale the new equity holders will have a broken trough, history will repeat itself?
Persons clearly affiliated with the developer, including, apparently, from the Argo company, go around the apartments of the houses adjacent to the construction site and try to buy up residential premises in apartment buildings on the territory of the property of 21 5th Donskoy Proezd, “in a blue eye” convincing owners that “the houses will still be demolished.” Some people believe this is fake.
The story of long-term construction and the purchase of residential premises on a land plot adjacent to it, which does not belong to the developer, would hardly have been possible without loans issued by Promsvyazbank PJSC for a problematic construction site.
It was precisely this circumstance that the residents of 5th Donskoy proezd drew the attention of the Bank of Russia to, writing a letter on behalf of the initiative group asking them to check the economic feasibility and feasibility of financing companies implementing this long-term construction, including the feasibility and intended use of borrowed funds allocated by Promsvyazbank PJSC, as well as sources and prospects for their return.
The Bank of Russia is required by law to supervise the compliance of credit institutions and banking groups with the legislation of the Russian Federation, including the exercise of internal control within the framework of Federal Law No. 115-FZ dated 07.08.2001 “On Counteracting the Legalization (Laundering) of Proceeds from Crime and the Financing of Terrorism” “.
The Bank of Russia promptly responded to the signal of the citizens, asking Promsvyazbank for clarification.
PJSC Promsvyazbank presented them, focusing in response to the fact that, they say, no less, “the construction of the Facility is classified as a large-scale investment project, and corresponds to the focus on achieving the indicators of the state program of the city “Housing”.
But this is not true! We wrote above that the Government of the capital, due to the violation of the deadlines for the implementation of the investment contract, as well as the numerous complaints of residents who disagree with the resettlement, at a meeting of the Urban Planning and Land Commission on July 2, 2021, it was decided to terminate the implementation of the investment project.
According to the Department of Investment and Industrial Policy, in pursuance of the decision of the Town Planning and Land Commission, an appeal was sent to the investor on June 17, 2021 to terminate the investment contract dated August 12, 2005 and the land lease agreement dated June 15, 2006 No. M-06-508083 (cadastral number 77 :05:0001010:33, address: Moscow, 5th Donskoy proezd, 21, buildings 1-5,7-14).
There is also a letter from the Prefecture of the South Administrative District of December 19, 2022 No. 01-15-14145/2 about this.
Why, then, did PJSC Promsvyazbank miss this very important “detail” in its response to the Bank of Russia?
Say, “everything is fine, beautiful marquise.” Probably in the hope that everything will be like Pushkin: “Ah, it’s not difficult to deceive me! .. I myself am glad to be deceived!”.
However, the people on the 5th Donskoy are in no hurry to be deceived and continue to ask uncomfortable questions to the authorities.
After all, with the help of open sources of information (including the Transparent Business service on the official website of the Federal Tax Service, EIZhS “Nash Dom. RF”, the portal “All-Russian system for checking counterparties ZACHESTNYYBUSINESS” and others), using various information services, such as SPARK- Interfax, Kontur.Focus, you can get data on the participants in the implementation of the “large-scale construction project” on 5th Donskoy.
For example, the fact that the developer of the Facility, LLC SZ 5 DONSKOY (TIN 7709414460), has a significant amount of unfulfilled financial obligations to creditors (more than 30 billion rubles). The average headcount for 2022 is 1 person. General Director – Blazhko M.E. is bankrupt, declared by the Arbitration Court (case No. А40-174896/2017 dated 05/18/2018).
Irina Sarynina, a member of the initiative group of residents of the 5th Donskoy, a financial specialist by profession, has many questions for the Argo company (TIN 9729299272), which is massively buying up residential apartments in this area.
– The company was established three years ago and has the characteristics of “technical companies,” Irina believes, “the minimum authorized capital, there is not a single employee in the average number of employees in the organization, salary calculations and tax deductions to the budget, respectively, were not carried out in 2021-2022. General Director Evlanov M.V. simultaneously holds managerial positions in other organizations.
In addition, according to published reports, Argo had an uncovered loss in the amount of more than 1.3 billion rubles at the beginning of 2023, and the book value of fixed assets and intangible assets at the end of 2022 is zero.
– Due to what the debts will be repaid, – Irina Sarynina is perplexed, – if the company does not produce anything, does not conduct any activity, except for buying apartments on a mortgage?
The residential premises (apartments) in the houses on 5th Donskoy Proezd bought out by Argo LLC, as well as the authorized capital of Argo, are under the burden of Promsvyazbank PJSC.
Residents of the 5th Donskoy recently sent their appeal to Rosfinmonitoring, a federal body that checks information on operations (transactions) with cash or other property in order to identify operations (transactions) related to the legalization (laundering) of proceeds from crime.
Of course, against the backdrop of today’s problems in Russia, the headache of several thousand residents living on 5th Donskoy, defending their homes and territories from unfortunate builders and incomprehensible realtors, may seem like a mere trifle to someone.
It seems that under the guise of financing a “large-scale project”, with someone’s connivance, actually unsecured loans are being withdrawn from the state bank.
Will it not turn out that the debts, as a result, will remain unpaid, and the collateral property in the form of apartments bought out by Argo LLC on 5th Donskoy Proezd, which should cover the amount of loans with its value, will turn out to be a fiction that exists only on paper ?
And will the problematic situation with equity holders fall on the shoulders of the authorities again?
As long as such “long-term construction projects” exist, and mythical skyscrapers flaunt on advertising pictures, the personal disasters of Russians will continue. It remains only to be surprised at the Olympic calmness of the supervisory authorities.
