Judicial debate has begun in Krasnoyarsk on the second criminal case of Anatoly Bykov, a businessman and former deputy of the regional legislature. According to the TFR, he hired a hitman to eliminate businessman Andrey Nekolov and vice-president of the regional boxing federation Andrey Grabovsky, but of the two “orders” he fulfilled only one. The prosecution requested 12 years in a strict regime colony for Anatoly Bykov, and taking into account the verdict in the first case, which also involved contract killings, 18 years in prison.
In the Central District Court of Krasnoyarsk, the debate of the parties began on the second criminal case against Anatoly Bykov, former chairman of the board of directors of the Krasnoyarsk aluminum plant and ex-deputy of the regional parliament. The first to speak was the state prosecutor Zhanna Volnistova, who stated that during the judicial investigation, the businessman’s guilt in the alleged crimes was established, it is confirmed by the totality of the evidence examined in the process.
The events described in the case file took place in 2004-2005.
According to the TFR version, in September 2004 Anatoly Bykov allegedly decided to eliminate Andrei Nekolov, the founder of the Krasnoyarsk industrial waste disposal company, and Andrei Grabovsky, vice president of the regional boxing federation.
The first refused to conduct joint business with him, the second went over to the camp of his opponent – a crime boss nicknamed Diplomat. Both murders, the investigation is sure, the businessman instructed Alexander Zhivitsa, promising to pay $50,000.
As stated in the case, on November 1, 2004, Alexander Zhivitsa shot the athlete’s BMW from a machine gun, but the bullets flew past. With the second “order” everything went according to plan. Alexander Zhivitsa collected detailed information about Andrey Nekolov’s place of residence and his travel schedules. On January 18, 2005, having tracked down the merchant, he did not leave him a chance to survive: he fired at least four times from a TT pistol, including twice in the head. Later, according to the materials of the investigation, Anatoly Bykov allegedly complained to the killer about the quality of work and paid only $ 10 thousand instead of the promised ones, reducing the amount of the fee due to the failed murder of Andrei Grabovsky. In June 2022, the trial began in the case.
As circumstances mitigating the guilt of Anatoly Bykov, the state prosecutor noted his age (he turned 63 in January), his state of health, his extensive charitable activities, and the presence of multiple awards from state and public organizations. When sentencing Alexander Zhivitsa, the prosecutor asked him to take into account his active assistance in solving and investigating crimes, the presence of a minor child.
In connection with the episode of attempted murder (Art. 33, Art. 105 of the Criminal Code of the Russian Federation) of Vice-President of the Regional Boxing Federation Andrei Grabovsky, the state prosecutor requested nine years in prison for Anatoly Bykov, and eight years for Alexander Zhivitsa. Since there were no grave consequences from this crime, and more than 18 years have passed since the incident, the prosecutor proposed to release the defendants from punishment due to the expiration of the statute of limitations.
In the episode with the murder (part 2 of article 105 of the Criminal Code of the Russian Federation) of businessman Andrei Nekolov, Anatoly Bykov was demanded 12 years in prison, and with the partial addition of the sentence of the Sverdlovsk District Court of Krasnoyarsk (in September 2021, the businessman was sentenced to 13 years for contract killing of two businessmen) – 18 years in prison in a strict regime colony. The widow of businessman Andrei Nekolov agreed with the position of the prosecutor, who demands to recover 50 million rubles from businessman Bykov. compensation for moral damage. Defendant Alexander Zhivitsa has already served his sentence for the murder of Andrey Nekolov.
On March 30, the defense side will speak in the debate. Lawyers declare the complete innocence of the businessman, in addition, they expressed doubts about the sincerity of the testimony of witnesses for the prosecution.
Anatoly Bykov himself claims that he has nothing to do with the events described in the case and considers his criminal prosecution to be political.
It should be noted that another criminal case is being investigated against Anatoly Bykov – the murder in 1998 of a major crime boss Vladimir Filippov (Philip).
