Fraud, bribes, drugs, a fatal accident and the use of powers to find a beloved dog – the High Qualifications Board of Judges allowed the criminal prosecution of four servants of Themis.
True, one of them, having collected a whole collection of serious articles of the Criminal Code, apparently left Russia, while the other has expired the statute of limitations for the alleged crime. Eight Articles
The High Qualification Board of Judges, during an extraordinary session on February 7, agreed to initiate a criminal case against the former chairman of the Pestrechinsky District Court of Tatarstan, Irek Nabiev. The list of crimes, the signs of which were seen by the chairman of the TFR Alexander Bastrykin in the acts of this servant of Themis, is quite impressive – we are talking about 11 episodes under eight articles. So, they want to charge Nabiev with kidnapping and extortion as part of an organized group, two especially large frauds and one – also especially large – bribe, incitement to abuse of authority, laundering of criminal proceeds, three facts of forgery of documents and drug trafficking.
According to the investigation, in 2017, as chairman of the Mendeleev Court of Tatarstan, Nabiev organized a criminal group to steal 76.8 million rubles from the account of Kisher LLC, writes Pravo.ru. The first two attempts were unsuccessful. The real head of the company, Vyacheslav Utrobin, prevented him from simply rewriting the company as a figurehead, after which he was kidnapped and tried to force him to transfer his post, but he refused. Then Utrobin was drugged and taken to the banks of the Kama, from where he was taken to the police and sent under administrative arrest. While the director was in isolation, the seals and documents of “Kisher” were stolen from him, as well as his passport, into which a photo of one of the group members, Alexei Kaimanov, was pasted. The latter came to the tax office and transferred the LLC to the right person, which made it possible to withdraw the company’s funds through shell companies.
It was Kaimanov, who once worked as a driver for Irek Nabiev, who testified against him and his accomplices. Kaimanov agreed to a pre-trial agreement and has already received his sentence – in January, the Supreme Court of Tatarstan gave him 6.5 years in a strict regime colony.
After giving confessions, a case was initiated against the nephew of a retired judge, Denis Nabiev, and two other residents of Naberezhnye Chelny. At the same time, according to the Tatarstan publication Realnoe Vremya, even before Bastrykin applied to the VKKS, a certain “person with a special legal status” was called in the materials as the organizer of the crime.
By the way, Denis Nabiev was not the only relative of the Tatarstan servant of Themis who fell under criminal prosecution. In July 2020, the court sentenced his son, Ramis Nabiev, former assistant prosecutor of the Moskovsky district of Kazan: he received 4 years in prison on charges of fraud.
And two months before that, Irek Nabiev resigned from the post of chairman of the Pestrechinsky District Court. According to sources of regional journalists, soon after his resignation, he could leave Russia, Germany and Georgia are mentioned as possible countries of his residence.
There were no statements that Nabiev had escaped from criminal responsibility, as in the case of his Kuban colleague Elena Khakhaleva, at the meeting of the HQCC, but the ex-judge himself was not present there, his interests were represented by a lawyer. According to the position of the defense, Nabiev was not involved in these crimes, and his persecution may be the result of serious contradictions that arose during the consideration of cases involving law enforcement officers. The lawyer also noted that Kaimanov testified against his client after the promises of the FSB and the TFR to release him under house arrest. But the members of the VKKS did not take these arguments into account and satisfied Bastrykin’s submission.
Arrival from Themis
Also, the members of the collegium gave the go-ahead to initiate criminal cases against judges of the Kolosovsky District Court of the Omsk Region of the Krasnodar Regional Court – Vladislav Kuminov and Yuri Zakharchevsky. They are both suspected of violating traffic rules, however, with different consequences.
Kuminov at the end of 2019, being acting. Chairman of the Kolosovsky District Court, maneuvered in his car and knocked down two people at a pedestrian crossing. One of them received serious bodily harm – fractures and a head injury.
At the meeting of the HQCC, the judge announced the expiration of the statute of limitations under the article imputed to him, and also insisted on his innocence. He noted that the collision occurred outside the pedestrian crossing, the victim was drunk and broke his head later, as a result of an unsuccessful fall. According to Kuminov, his criminal prosecution is the machinations of investigators who had previously unsuccessfully tried to influence his decision in the case of giving a bribe.
Yuri Zakharchevsky, on the contrary, did not connect the attempts of criminal prosecution with his professional activity, citing other arguments in favor of his innocence. Meanwhile, his accusations are much more serious: the investigators want to bring him under two articles – on violation of traffic rules that resulted in the death of a person, and on leaving him in danger.
In April 2020, a judge of the Krasnodar Regional Court collided with a cyclist while driving his Land Cruiser and left the scene. The victim died as a result of his injuries. Zakharchevsky attributed the incident to a “clouded mind” due to malaise, to repair work at the scene of an accident, and to the fact that the deceased cyclist was drunk and made incorrect maneuvers.
By the way, Zakharchevsky appeared before the HQCJ as a no longer acting judge – on February 1, the day after the publication of the agenda for the meeting of the board of the CCC of the Krasnodar Territory, he satisfied his application for termination of office.

Oddly enough, two more cases submitted for consideration by the VKKS related to love for pets. We are talking about the ex-chairman of the Kupinsky District Court of the Novosibirsk Region Tamara Koshlak and the former justice of the peace of the 2nd court district of the Ob Tatyana Lisina.
In 2013, Lisina lost her dog, a Dogue de Bordeaux named Zidane. The judge did not turn to law enforcement officers, using the services of a private detective. And in order to make his work easier, she sent a judicial request to detail the calls of the woman who took the dog to the exhibition and stated that the animal died suddenly on the way.
The result was Bastrykin’s submission to initiate a case of abuse of power, which the HQCC satisfied in September 2020. But later it turned out that a similar request for billing at the request of Lisina was sent by her colleague Tamara Koshlak. The chairman of the ICR sent a motion to bring her to justice under the same article on abuse of power, and Lisina wanted to impute the organization of the crime.
Both women did not attend the meeting, citing illness. As it turned out, Koshlak is on a planned hospitalization, and Lisina has contracted covid. As a result, the submission regarding the first was satisfied, and the consideration of the case of the second was postponed to February 16, Pravo.ru writes.
