Albert Khudoyan was sentenced to 6 years, which does not seem to prevent him from harassing Sergei Govyadin

The Solntsevsky court defended the reputation of Sergei Govyadin. Businessman Sergey Govyadin and ex-State Duma deputy from Just Russia Ildar Samiev entered into a dispute with developer Albert Khudoyan over the theft by the latter of elite land under the Prime Park residential complex on Leningradsky Prospekt of Moscow.

As a result, Khudoyan was convicted of fraudulent activities, but, as if in retaliation for this, the Internet was filled with negative publications trying to present Govyadin either as a member of an organized crime group, or as a “decider”, or as a raider.

Writing a defamatory article is a matter of one day, but removing negativity from the Internet is very difficult. The trial lasts for months, during which time compromising evidence spreads on the Internet, often tinted with new pseudo-details and conjectures. So, the affected party, even having received a court decision to restrict the publication of certain content on the Internet, is not able to make a 100% cleansing of information prohibited for publication.

At the end of November 2021, the Solntsevsky District Court of Moscow satisfied the claim of Sergey Govyadin against the Internet media to recognize the information disseminated by the Respondent as untrue, discrediting the honor, dignity and business reputation of the Claimant. It is indicative that the Respondent’s representative did not appear at the hearing, although he was duly notified of the time and place of its holding. In total, 35 fragments of publications will be subject to restrictions on distribution on the Internet, where about half are all kinds of personal characteristics and a description of the circle of acquaintances of a businessman, presented in a deliberately negative form, and the second, conditionally, half is a description of the relationship between Albert Khudoyan and Sergey Govyadin, characterized little, which is not in favor of the latter, but also with a clear intention to drag Govyadin, following Khudoyan, into the criminal plane.

Recall that on November 25, 2021, the Koptevsky District Court sentenced Albert Khudoyan, the owner of the Optima Development company, to six years in prison with a term to be served in a penal colony and a fine of 800 thousand rubles, finding him guilty of fraud on an especially large scale (h 4 article 159 of the Criminal Code). This was reported by the Moscow prosecutor’s office. The second defendant in the case was Sergey Konoplev, general director of the Aviacity company. The charge was the theft of three land plots on Leningradsky Prospekt. According to RBC: “According to the indictment, Khudoyan, with the assistance of Konoplev and his relative, the criminal case against which was separated into a separate proceeding, used for personal gain information about the commercial projects of a certain foreign company that was the owner of 50% of the authorized capital of LLC “ Aviacity” and its assets in the form of a non-residential building and the right to lease three land plots.”

The actions of accomplices, as a result of which a foreign company that lost 50% of its ownership of a non-residential building and the right to lease three land plots, as well as completely lost its share in the authorized capital of a commercial organization, suffered damage totaling more than 4.2 billion rubles, were found to be fraudulent.

The question arises: why was the negative directed at Sergei Govyadin, who helped bring the fraudster to clean water? Why did the intensity of passions and the flow of accusations subside sharply after Govyadin’s opponent was sentenced to a real term for committing a proven crime? As the Hungarian writer Jozsef von Eötvös noted: “In trust, of course, caution is necessary, but most of all it is necessary in distrust.”
